BACKGROUND INFORMATION
Background: Reason for replacement item - Corrected Napoleon McCovery’s term to continue from March 1, 2023.
Staff has verified that the appointees meet the requirements set forth in §11-88-6, et seq., Code of Alabama 1975 to be appointed to the Board of Directors of the Authority.
GENERAL BACKGROUND - APPOINTMENT TO WATER, SEWER & FIRE PROTECTION AUTHORITIES - PARK CITY WATER AUTHORITY
This Authority is a public corporation established in 1977, as the Park City Water & Fire Protection Authority, pursuant to Act No. 107, 1965 First Special Session of the Legislature of Alabama, which is now codified at §11-88-1, et seq., Code of Alabama 1975.
Further, in 1989, the Authority changed its name to the Park City Water Authority. Lastly, this Authority is composed of a three (3) member Board of Directors appointed by the Commission to serve, respectively, terms of six (6) years each.
There remains "required qualifications" set forth in §11-88-6 Code of Alabama 1975 for citizens to be appointed to the Authority. The "required qualifications" are for nominees to:
1. Be a duly qualified elector (i.e. registered voter) in Baldwin County; and
2. Be a resident of that part of the service area of the Authority; and
3. Be an owner of real property in that part of the service area of the Authority; and
4. Not be an officer of the state, county or municipality.
Furthermore, on this Authority all regular appointments, and appointments to vacancies, are made by the Commission.
Lastly, there is a provision in §11-88-6 Code of Alabama 1975 which requires appointments or reappointments to be made no earlier than thirty (30) days prior to the date such appointment is to be effective [i.e. the Commission can't make appointments thirty-one (31) days or more in advance to an expired Board Members term]. The above staff recommendation is compliant to said law.
