BACKGROUND INFORMATION

Previous Commission action/date:  See below.

Background:  Ecovery, LLC is requesting that its current sales and use tax exemption certificate which expired on January 1, 2024, be extended to December 31, 2024, for Ecovery, LLC to complete its current facility expansions.  See attached request letter from Ecovery, LLC.

The Commission approved a Tax Abatement Agreement with Ecovery, LLC on April 5, 2022, for its facility expansion project.  The Tax Abatement Agreement was amended on April 18, 2023, due to the increase in the capital investment amount for the project by Ecovery, LLC.

Section 40-9B-1, et seq., Code of Alabama 1975, or what is commonly referred to as the "Tax Incentive Reform Act of 1992," authorizes certain entities to grant Tax Abatements in their respective effort to attract new industries and encourage existing industries to expand their pursuits in their varied jurisdictions.
