STAFF RECOMMENDATION

Recommendation

Adopt Resolution #2024-079 of the Baldwin County Commission allocating up to $134,062.50 (29970010.55240) of American Rescue Plan Act (ARPA) funds (299.44881) for the architectural and engineering design services of the Baldwin County Courthouse Queuing Structure.

BACKGROUND INFORMATION

Background:  The Final Rule issued by the U.S. Department of Treasury on January 6, 2022, identifies specific COVID-19 mitigation and prevention uses, including support for prevention, mitigation, or other services in public facilities. The construction of the open-air queuing structure and enclosed ramps will provide shelter from the elements while allowing the public to social distance. This is a low-cost method of mitigating the spread of COVID-19 and other airborne diseases to benefit the individuals accessing public services at this facility.

The Architect, PH&J Architects, Inc., was selected from the Association of County Commissions of Alabama (ACCA) approved list of Architects through a competitive process to be used on ARPA projects.

Previous Commission action/date:

December 19, 2023 - The BCC approved the design of the new outdoor Atrium at the Baldwin County Courthouse located in Bay Minette for the estimated construction cost of $2,257,562.50 and authorized the Purchasing Director and Architect to bid the project.

The period of performance for this Agreement shall begin on the date of execution of the Agreement by both parties and shall end upon the completion of the project or on December 31, 2026.

July 5, 2023 - The BCC adopted Resolution #2023-139 which repealed and rescinded Resolution #2023-120 adopted by the Baldwin County Commission on May 16, 2023, which allocated up to $948,830.00 of American Rescue Plan Act (ARPA) funds for the Baldwin County Courthouse Outdoor Atrium Project; and terminated the AIA Agreement for architectural services with PH&J Architects, Inc., for the design of the Baldwin County Courthouse Outdoor Atrium located in Bay Minette, Alabama, approved by the Baldwin County Commission during its May 16, 2023, regular meeting (Agenda Item GA3) and authorize the Chairman to execute a Notice of Termination letter to PH&J Architects, Inc., as required in Article 9 of the Agreement, said termination effective July 13, 2023.

May 16, 2023 - The BCC adopted Resolution #2023-120 of the Baldwin County Commission, allocating up to but not to exceed $948,830.00 of ARPA funds for the Bay Minette Courthouse Outdoor Atrium; and approved and authorized the Chairman to execute the AIA Professional Services Contract with PH&J Architects, Inc. in the amount of 6.5% of the construction cost for the Design of Bay Minette Courthouse Outdoor Atrium.
