Recommendation
Award the bid for Project No. HW21103000 - The Launch at County Road 6 to the lowest responsible bidder, McElhenney Construction Co., LLC, in the Bid Amount $5,248,877.37; Construction Time: 135 working days; and authorize the Chairman to execute the Contract.

BACKGROUND INFORMATION
Background: Bids were opened in the Purchasing Conference Room on April 10, 2024, at 2:30 p.m. Three (3) bids were received. The bid received from the apparent low bidder, Mitchells Contracting Services, Inc., made a mathematical error of (-$55,809.69) which decreased their bid price. Mitchells Contracting Services, Inc., did not include the signed addendum in their bid package as required by the contract documents. The bid documents states “Bidders are required to submit all Contract documents and Specifications, including any addendums, upon submittal of bid.”
The next lowest bidder, McElhenney Construction Co., LLC, had a mathematical error which increased their bid price by $30.00. Their total bid amount is $5,248,877.37 as per the attached Bid Tabulation. The Baldwin County Assistant County Engineer, Mark Acreman, has reviewed the bid responses and has submitted the certified Bid Tabulation and a letter recommending that the bid be awarded to the lowest responsible bidder, McElhenney Construction Co., Inc., as per the attached Bid Tabulation.
Previous Commission action/date:
11/21/2023 meeting: 1) Approved and authorize the Chairman to execute a Gulf of Mexico Energy Security Act (GOMESA) Grant Agreement between the State of Alabama Department of Conservation and Natural Resources (ADCNR) and the Baldwin County Commission to receive $4,820,000.00 for the construction of The Launch at CR 6; and 2) Approved the Purchasing Director to place a competitive bid for The Launch at CR 6 Construction Project; and 3) Approved the Chairman to execute any project related documents.
