STAFF RECOMMENDATION

Recommendation

As relates to the Planning & Zoning Department Consultant Services, take the following actions:

Approve a contract for engineering services with Jacobs Engineering Group Inc. to review and make suggestions for improvement to the Baldwin County Subdivision Regulations. The purpose of the project is to assess whether the County’s current Regulations meet the present and future needs of the County and to provide suggestions to improve the Regulations to consider the impact of potential wastewater produced and sewer connections required by the development. The County also requests the review of information submitted to the County by Baldwin County Sewer Service (BCSS) and the review of information available from ADEM regarding the BCSS Fort Morgan Wastewater Treatment Plant to determine the ability to serve new developments in accordance with the current County Subdivision Regulations that are being reviewed for permitting by the County. The purpose of this review is to develop a written report of the ability of the Fort Morgan Wastewater Treatment Plant to serve additional developments in its current state of operation under the conditions of the current state of the ADEM permit.

This Contract shall be effective and commence immediately upon the same date as its full execution, and same shall terminate upon either the expiration of thirty-six (36) months or upon a written notification thereof received by either party within the required ten (10) day period.

BACKGROUND INFORMATION

Background:  The Planning and Zoning Staff respectfully requests the Baldwin County Commission approve a contract for engineering services with Jacobs Engineering to review and make suggestions for improvement to the Baldwin County Subdivision Regulations and to evaluate information and permits provided regarding the Baldwin County Sewer Service Fort Morgan Wastewater treatment plant to determine the ability to serve new developments in accordance with the County Subdivision Regulations.

Planning and Zoning Staff are in the process of updating the Baldwin County Subdivision Regulations. The growth within Baldwin County that has occurred in recent years has caused the need to evaluate many of our development requirements, including utility infrastructure, to ensure that we are evaluating developments based upon current industry standards. As a deliverable to this contract, Jacobs Engineering will provide a third-party review of our regulations and compare them with current industry standards to provide Planning and Zoning Staff with a technical memorandum of their findings and recommended updates to the Subdivision Regulations.

Additionally, over the past several years there has been a significant amount of uncertainty about the ability of the BCSS Fort Morgan Wastewater Treatment Plants ADEM permit, permit compliance, and available capacity to adequately serve additional developments. Jacobs Engineering will also provide a review of all available information to provide a third-party opinion of the ability to serve additional developments in accordance with the Baldwin County Subdivision Regulations.

The fee structure is time and materials for a cost not to exceed $64,600.00
