STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Approve and authorize the Chairman to sign the Right of Entry with Release Agreement between the Baldwin County Commission and Novelis Corporation; and
2) Authorize staff to name Novelis Corporation as an additional insured and provide a copy of the insurance certificate to Novelis Corporation.

BACKGROUND INFORMATION
Background: The Baldwin County Commission is considering approval of a Right of Entry with Release Agreement with Novelis Corporation to allow the County and its representatives to enter designated portions of the Novelis property for surveying and geotechnical investigations associated with the design of the Baldwin Beach Express II and Willie Cooper Road Extension projects.
The Agreement authorizes the Baldwin County, its employees, contractors, and agents, including Volkert, Inc., to perform surveying and soil boring activities necessary to support the design process. The Agreement further provides that the County will indemnify and hold harmless Novelis Corporation from claims, damages, liabilities, and related costs arising from the County’s activities on the property.
The Right of Entry with Release Agreement will remain in effect through December 31, 2026, unless extended by mutual written agreement of the parties.
Previous Commission action/date: June 2, 2026 - Approved the Engineering Proposal with Volkert, Inc., for design of the Willie Cooper Road Extension with design fees not to exceed $1,724,763.00.
