STAFF RECOMMENDATION

Recommendation

Due to the passage of Act 2023-306, terminate the Agreement for the Distribution of Mental Health Funds Pursuant to Section 45-2-80.130 of the Code of Alabama, 1975, between the Baldwin County Commission, the Twenty-Eighth Judicial Circuit Court of Alabama by and through its Presiding Circuit Judge, and the District Attorney of Baldwin County, effective August 1, 2023.

BACKGROUND INFORMATION

 

Background:  Section 45-2-80.130 of the Code of Alabama, 1975, provides for the assessment of an additional $10.00 of court costs for the creation, implementation, and continuing administration of a mental health diversionary program.  Act 2023-306 passed during the 2023 Legislative Session changes the law by charging the presiding District Judge with the management of the Mental Health Court Funds.  When the law goes into effect on August 1, 2023, the current agreement between the Commission, the District Court, and the District Attorney is no longer necessary.

 

Previous Commission action/date: 

11/16/2022 Regular Meeting - The Commission approved the First Amendment to the Agreement for the Distribution of Mental Health Funds and the distribution of the funds received from Baldwin County Legislative Delegation’s Baldwin County Community Capital Fund to Baldwin County Mental Health Court.  The amendment was done in order to include the distribution of Circuit Court funds to entities and accounts as directed by the Presiding Judge of the Circuit Court.

 

08/17/2021 Regular Meeting - The Commission approved the Agreement for the Distribution of Mental Health Funds between the Baldwin County Commission, the Circuit Court and the District Attorney and the distribution of the funds received from the Delegation’s Baldwin County Community Capital Fund to Baldwin County Mental Health Court. 

 

08/03/2021 Regular Meeting - The Baldwin County Commission accepted funds in the amount of $100,000.00 from the Baldwin County Legislative Delegation’s Baldwin County Community Capital Fund (Fund 744) to be used to benefit the Baldwin County Mental Health Court for the purpose of providing assistance and resources to individuals with mental illnesses.
