STAFF RECOMMENDATION

Recommendation

Take the following actions:

1) Approve Baldwin County Sheriff's Office (BCSO) staff to submit the Equitable Sharing Agreement and Certification Report for Fiscal Year 2024-2025, to the U.S. Department of Justice, detailing the funds received and spent by BCSO from federal forfeiture cash received from cases that the BCSO participated in during Fiscal Year 2024-2025; and

2) Authorize Kimberly Kelly, Director of Finance for BCSO, to upload the Agreement to the Department of Justice through its eShare portal.

BACKGROUND INFORMATION

 

Background: BCSO participates in the Federal Equitable Sharing Program with the Department of Justice and The Department of Treasury. BCSO receives forfeited cash and property from federal cases.

 

An annual report is required to be submitted within sixty (60) days of the fiscal year end to the Department of Justice and Treasury showing the amount of funds the BCSO received and how they were used. The Office of Examiners of Public Accounts audits this account each year when the Baldwin County Commission is audited.

 

Previous Commission action/date: 11/05/2024 - Last BCC Equitable Sharing Agreement approved.

Lowery; Administrative staff of BCC will have chairman sign, seal, and courier the original fully executed agreement to Kimberly Kelly.

 

Kimberly Kelly will upload the executed agreement to the Department of Justice and will provide the Baldwin County Commission verification that the agreement was uploaded and accepted by the Department of Justice
