Adopt the revised Baldwin County Commission Policy #2.6 - Alcohol License Applications.

BACKGROUND INFORMATION

 

Previous Commission action/date:  April 19, 2022, BCC Regular meeting - Last revision to Policy #2.6 approved by the Commission. 

 

Background:

 

SUMMARY OF REVISIONS

 

The requirement for the Applicant to provide proof of the Health Department’s approval has been removed to streamline the process for the Applicant. The ABC Board requires Applicants to provide proof of Health Department approval for annually renewable on-premises licenses.  The ABC Board does not require a health permit for temporary special events or off-premises licenses.  Since the Health Department requires off-premises and special event vendors (except certain non-profits or events sponsored by a government agency) to obtain a permit, County staff will continue notifying the Health Department after the Commission vote.

 

The “Consent for Inspection” form has been updated to read “Consent to Enter Property” since County staff does not inspect the facility but enters the property to place the public notice sign and remove it after Commission action.

 

•Public notice requirements have been removed for temporary, non-renewable special events licenses.

 

Alabama Code Section 28-3A-23

Regulation of grant of licenses.

 

(e) Each retail liquor license application must be approved by the governing authority of the municipality if the retailer is located in a municipality, or by the county commission if the retailer is located in the county and outside the limits of the municipality before the board shall have authority to grant the license.
