STAFF RECOMMENDATION

Recommendation

Take the following actions:

 

1) Approve a Reimbursable Utility Agreement between the Baldwin County Commission and Baldwin County Sewer Service LLC for the relocation of utilities to complete the widening and intersection improvements on County Road 64 from State Road 181 to Montelucia Way. The estimated in-kind cost of this relocation is $1,680,861.50 with the Eastern Shore Metropolitan Planning Organization funding 80% ($1,344,689.20) and Baldwin County funding the remaining 20% ($336,172.30); and 

 

2) Approve a Reimbursable Utility Agreement between the Baldwin County Commission and City of Fairhope Utilities for the relocation of utilities to complete the widening and intersection improvements on County Road 64 from State Road 181 to Montelucia Way. The total estimated cost of this relocation is $415,937.50 with the Eastern Shore Metropolitan Planning Organization funding 80% ($332,750.00) and Baldwin County funding the remaining 20% ($83,187.50).

 

BACKGROUND INFORMATION

 

Background:  The County Road 64 Widening Capacity Project has multiple utility conflicts along the entire corridor. The reimbursable utility agreements with Baldwin County Sewer Service LLC and City of Fairhope Utilities will outline the terms for relocation. The Commission approved $1,000,000.00 in FY 2024 Budget and $1,000,000.00 in FY 2026 Budget for utility relocation.

 

Previous Commission action/date: 

September 16, 2025 - Approved a Reimbursable Utility Agreement between the BCC and Belforest Water System for the relocation of utilities to complete the widening and intersection improvements on County Road 64 from State Road 181 to Montelucia Way. The total estimated cost of this relocation is $2,823,080.00 with the Eastern Shore MPO funding 80% ($2,258,464.00) and Baldwin County funding the remaining 20% ($564,616.00).

 

August 19, 2025 - Approved a Reimbursable Utility Agreement between the BCC and Riviera Utilities for the relocation of utilities to complete the widening and intersection improvements on County Road 64 from State Road 181 to Montelucia Way. The total estimated cost of this relocation is $543,115.93 with the Eastern Shore MPO funding 80% ($434,492.74) and Baldwin County funding the remaining 20% ($108,623.19).

 

August 19, 2025 - Approved a Non-Reimbursable Utility Agreement with each of the following companies for the relocation of utilities to complete the widening and intersection improvements on County Road 64 from State Road 181 to Montelucia Way at no cost to the project: AT&T, C-Spire, and Uniti Fiber. The agreements shall be effective upon full execution and will terminate upon completion of the project.

 

February 18, 2025 - Adopted Resolution #2025-073 and approved the Utility Agreement between the BCC and ALDOT for utility relocation for widening, resurfacing and intersection improvements on County Road 64 from State Road 181 to Montelucia Way using 80% Federal funds and 20% County matching funds.

 

January 21, 2025 - Approved the Purchasing Director to place a competitive bid for the County Road 64 Clearing and Grubbing Project; and approved the Chairman to execute any project related documents.

 

April 5, 2022 - Approved Resolution #2022-067 and a funding agreement between the BCC and ALDOT for right-of-way acquisition for the widening, resurfacing and intersection improvements on County Road 64 from State Road 181 to Montelucia Way using 80% Federal funds and 20% County matching funds.

 

October 1, 2019 - Approved Resolution #2020-011 and submitted a Letter of Intent to use Federal Funds for the County Road 64 Capacity Improvement Project to ALDOT as part of the project initiation process.

 

July 16, 2019 - Waived BCC Policy #9.10 - Engineering and Surveying Services and approved on-call consultant Volkert, Inc. to perform design services for the County Road 64 Capacity Improvements Project, with design fees not to exceed $526,142.00. The Eastern Shore MPO will fund 80% of the design fees and the County will provide the 20% local match.

 

April 16, 2019 - Approved Resolution #2019-059 and a funding agreement between the BCC and ALDOT for the Preliminary Engineering to 3-lane County Road 64 from State Route 181 to County Road 54 East and install a Roundabout.
