STAFF RECOMMENDATION

Recommendation

Take the following actions:

 

1) Adopt Resolution #2024-013 of the Baldwin County Commission retroactively allocating $620,000.00 of ARPA funds for the Baldwin County Materials Recovery Facility architectural and design services; and

 

2) Approve and authorize the Chairman to execute ADDENDUM No. 1 to the Professional Services Agreement No. 1895R3 with LaBella Associates, D.P.C., that Professional Services Agreement approved and authorized for execution by the Chairman during the Regular Meeting on February 1, 2022, contingent on the acceptance and execution by both parties.

 

The expenditure of ARPA funds for the purposes described herein shall be further contingent on the continued appropriation and availability of ARPA funds for this purpose and in no event shall be used for any expenses not obligated by December 31, 2024, and expended by December 31, 2026.

 

The period of performance for ADDENDUM No. 1 to the Professional Services Agreement No. 1895R3 shall begin on the date of execution of ADDENDUM No. 1 by both parties and shall end upon the completion of the project or on December 31, 2026.

BACKGROUND INFORMATION

 

Background:  Baldwin County Solid Waste engages LaBella to perform professional services on various projects including the development of a Current and Future Needs Study and Basis for Engineering Design, Permitting Support, Engineering Design, Bid Support, and Construction Management to assist the Client in the planning, procurement, installation, and start-up of a regional processing Materials Recovery Facility (MRF).

 

Previous Commission action/date:  February 1, 2022 - Authorized the Chairman to execute the Professional Services Agreement - Agreement No. 1895R3 between LaBella Associates, D.P.C. and Baldwin County Commission for the engineering, environmental, and design services for the new Materials Recovery Facility to be located adjacent to the Magnolia Landfill, in Summerdale, Alabama.

 

November 2, 2021 - Authorized staff to begin negotiations with LaBella Associates, firm awarded the Engineering/Environmental/Design Services for a new recycling facility to be located adjacent to Magnolia Landfill.

 

September 7, 2021 - Approved the Request for Qualifications (RFQ) for the Engineering/Environmental/Design Services for a new recycling facility to be located adjacent to Magnolia Landfill and authorized the Purchasing Director to advertise the RFQ.

 

July 6, 2021 - Approved to budget $6,600,000.00 of the American Rescue Plan Act (ARPA) funds to design, construct and purchase equipment for a new recycling facility to be located adjacent to Magnolia Landfill. The Baldwin County Material Recovery Facility Project’s principal purpose is to provide a long-term solution for the recycling needs of Baldwin County, its resident Municipalities, and local businesses. Project objectives also include utilizing locally available sources to fund the development and construction of the project.
