STAFF RECOMMENDATION

Recommendation

At the request of the City of Spanish Fort, approve Baldwin Regional Area Transit System (BRATS) to donate transportation services for the 15th Annual Delta Woods and Waters Expo to be held at 5 Rivers Delta Resource Center on Saturday, April 26, 2025, from 8:00 a.m. to 5:00 p.m.

One bus will be operated by a BRATS driver for 10.5 hours at a donated cost of $780.78

BACKGROUND INFORMATION

 

Background:  Staff received a request on February 13, 2025, from Michael M. McMillan, Mayor of Spanish Fort, requesting the Baldwin County Commission provide one (1) BRATS bus to assist with the Annual Delta Woods and Waters Expo on Saturday, April 26, 2025, from 8:00 a.m. to 5:00 p.m. to shuttle guests on the 5 Rivers property.

 

The mission of the Delta Woods and Waters Expo is to promote responsible and enjoyable outdoor recreation experiences through a fun and educational event.

 

Under 49 CFR, “if a third party requests charter service for the exclusive use of a bus or van, but the transit agency provides the service free of charge, the transit service does not fall under the charter service restrictions.  The definition of charter service under 49 CRF Section 604.3(c) requires a negotiated price, which implies an exchange of money. Thus, free service does not meet the negotiated price requirement.
