STAFF RECOMMENDATION

Recommendation

Authorize the Baldwin County Sheriff to enter into the 287(g) Service Agreement between United States Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), and Baldwin County Sheriff’s Office (BCSO) for the purpose of Enforcement and Removal Operations (ERO).


BCSO officers shall be eligible for overtime reimbursement. Funds received will be submitted to the County Commission for overtime reimbursement costs.


The agreement will remain in effect for a period not to exceed 36 months unless extended by bilateral modification or terminated in writing by either party. Either party may terminate this agreement by providing written notice of intention to terminate the agreement, a minimum of 60 calendar days in advance of the effective date of termination.

BACKGROUND INFORMATION

 

Background:  Participation in the Service Agreement 287(g) Task Force Model for the ERO program allows the BCSO to enhance public safety by strengthening cooperation with federal immigration authorities to identify and address individuals who pose a demonstrable threat to the community and who are illegally in the United States.

 

By operating within clearly defined legal parameters and with federal oversight, the program helps ensure that offenders encountered in the course of normal law-enforcement duties are properly identified and transferred to ICE for appropriate action. This partnership promotes accountability, efficiency, and a coordinated approach to playing a role in immigration enforcement while maintaining the Sheriff’s Office core mission of protecting all residents.

 

Previous Commission action/date:  March 17, 2026 - Approved the MOA 287(g) Task Force Model between ICE, a component of the DHS, and BCSO for the purpose of ERO.
