STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Approve the Chairman to execute an Underground Pipeline Easement with the Alabama Department of Conservation and Natural Resources giving Baldwin County rights to construct and maintain a drainage improvement project along State Highway 180 in Fort Morgan for Surfside Shores; and
2) Approve the Chairman to execute any project related documents.

BACKGROUND INFORMATION
Background:
Surfside Shores has had numerous localized flooding events in several areas along the east-west streets, primarily Palmetto Drive and Driftwood Drive. It appears the flooding can be associated with a high groundwater table combined with the lack of an adequate storm sewer system. This flooding is causing septic tanks to fail as stormwater is flooding properties for extended time periods. This project will construct a closed stormwater system that will utilize overflow structures at each pond to discharge runoff into a main trunk line along Surfside Drive. This trunk line will run north to Fort Morgan Road (State Route 180), then run east to Kiva Way for approximately 1,200 feet, and then discharge toward the north into Mobile Bay. Once completed, the improvements will reduce time and severity of the localized flooding as well as allow for the existing septic systems to function as intended. This project could have positive impacts to over 200 existing properties.
This right-of-way easement is for a term of ten (10) years, beginning upon full execution and expiring August 1, 2034, with the option to renew for additional terms as agreed upon by Grantee and Grantor, none of which may exceed ten years.
Previous Commission action/date:
December 20, 2022 - The Commission approved the Purchasing Director to place a competitive bid for the Surfside Shores Drainage Improvements Project; and approved the Chairman to execute any project related documents.
