STAFF RECOMMENDATION
Recommendation
As it relates to Competitive Bid #WG25-31 - Provision of Paint Striping Materials, take the following actions:
1) RESCIND the portion of the action taken by the Baldwin County Commission during its July 16, 2025, Regular Meeting, related to Agenda Item CE2, awarding the item listed below to the lowest bidder, Potters Industries, LLC:
Item #4 - Glass Bead: Visilok Type 1 D-2 Intermix System or Equivalent, Shipped in 50-90 lb. Moisture Proof Bags on Pallets - $0.96 per pound; and
2) AWARD the bid to the next lowest responsible bidder, The Pittsburgh Paints Co., for the item listed below:
Item #4 - Glass Bead: Visilok Type 1 D-2 Intermix System or Equivalent, Shipped in 50-90 lb. Moisture Proof Bags on Pallets - $3.25 per pound.

BACKGROUND INFORMATION
Background: Potters Industries, LLC, submitted an email dated September 9, 2025, requesting to withdraw the bid for Item #4 - Glass Bead: Visilok Type 1 D-2 Intermix System or equivalent, shipped in 50-90 lb. moisture proof bags on pallets, due to them submitting their pricing incorrectly.
The Code of Alabama Section 41-16-57 (a) states "If at any time after the award has been made the lowest responsible bidder notifies the awarding authority in writing that the bidder will no longer comply with the terms of the award to provide the goods or services to the awarding authority under the terms and conditions of the original award, or the awarding authority documents that the lowest responsible bidder defaults under the terms of the original award, the awarding authority may terminate the award to the defaulting bidder and make an award to the second lowest responsible bidder for the remainder of the award period without rebidding, provided the award to the second lowest responsible bidder is in all respects made under the terms and conditions contained in the original bid specifications and is for the same or a lower price than the bid originally submitted to the awarding authority by the second lowest responsible bidder.”
Staff recommends the Commission rescind the award made to Potters Industries, LLC, and award the bid to the next lowest responsible bidder, The Pittsburgh Paints Co., for Item #4 - Glass Bead: Visilok Type 1 D-2 Intermix System or equivalent, shipped in 50-90 lb. moisture proof bags on pallets. Revised Award Listings attached for review.
Previous Commission action/date: 07/16/2025 meeting: Awarded Bid #WG25-31 for the Provision of Paint Striping Materials to the lowest bidders, Crown USA, Inc., Ennis-Flint, Inc., The Pittsburgh Paints Co., and Potters Industries, LLC, per the Award Listing.
