STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Adopt Resolution #2025-077 of the Baldwin County Commission approving Amendment #2 to the Subrecipient Agreement with the City of Loxley for the ARPA-Funded Water Capacity Improvement Project; and
2) Approve and authorize the Chairman to execute Amendment #2 to the Subrecipient Agreement with the City of Loxley.
The period of performance for this Agreement shall begin on the date of execution of the Agreement by both parties and shall end upon the completion of the project or on April 30, 2025.

BACKGROUND INFORMATION
Background: Amendment #2 to the Subrecipient Agreement extends the budget period and period of performance until 11:59 p.m. on April 30, 2025, to allow for completion of the water infrastructure project and grant closeout.
The BCC, during its regularly scheduled meeting held on July 5, 2023, took action to approve and authorize the Chairman to execute the Agreement between the BCC and the City of Loxley. The Agreement reflects a period of performance and associated budget period extending through August 31, 2024. The BCC, during its regularly scheduled meeting held on December 17, 2024, took action to approve and authorize the Chairman to execute Amendment #1 to extend the budget period and period of performance to February 28, 2025.
Previous Commission action/date: A summary of previous Commission ARPA action is attached.
December 17, 2024 - BCC approved Resolution #2025-058 of the BCC approving Amendment #1 to the Subrecipient Agreement with the City of Loxley for the ARPA-Funded Water Capacity Improvement Project.
July 5, 2023 - BCC approved Resolution #2023-135 of the BCC allocating up to $750,000.00 of ARPA funds to the City of Loxley for a Water Infrastructure Project; and authorized the Chairman to execute the Agreement between the BCC and the City of Loxley, contingent on acceptance and execution by the municipality.
