STAFF RECOMMENDATION
Recommendation
Adopt Resolution #2024-034 of the Baldwin County Commission allocating a total of $4,604,000.00 of American Rescue Plan Act (ARPA) revenue replacement funds to be used toward the design services and construction costs of the Magnolia Material Recovery Facility (MRF).
The expenditure of ARPA funds for the purposes described herein shall be further contingent on the continued appropriation and availability of ARPA funds for this purpose and in no event shall be used for any expenses not obligated by December 31, 2024, and expended by December 31, 2026.

BACKGROUND INFORMATION
Background: In accordance with the final rule issued by the U.S. Department of Treasury on January 6, 2022, the County has duly elected to take the standard allowance of revenue replacement funds equal to $10,000,000.00 of its ARPA funds (“ARPA” revenue replacement funds”).
From the total $4,604,000.00 allocated ARPA funds, prior Material Recovery Facility expenses have been incurred by the Commission including payment of invoice(s) from Persons Services, Corp. in the amount of $514,694.06, and purchase of a Ram Baler at a cost of $569,306.00.
