STAFF RECOMMENDATION
Recommendation
Regarding the Baldwin County Historic Development Commission, take the following actions:
1) Reappoint Ms. Yolanda Devine Johnson for a four (4) year term, said term to commence July 3, 2026, and expire July 3, 2030; and
2) Reappoint Mr. Curry Weber for a four (4) year term, said term to commence on July 3, 2026, and expire July 3, 2030; and
3) Reappoint Mr. David Swift for a four (4) year term, said term to commence on July 3, 2026, and expire July 3, 2030; and
4) Recognize that Mr. William Underwood will not seek reappointment upon the expiration of his term, effective July 3, 2026, and thank him for his civic service as a member of the Board; and
5) Appoint Ms. Torrey V.A. DeKeyser for a four (4) year term to fill the place seat formerly held by Mr. William Underwood, said term to be effective July 3, 2026, and expire July 3, 2030; and
6) Accept the resignation of Mr. Alan Samry, effective immediately, and thank him for his civic service as a member of the Board; and
7) Appoint Ms. Kim Marsh for a pro-rata reduced four (4) year term to fill the place seat formerly held by Mr. Alan Samry, said term to commence April 21, 2026, and expire July 3, 2029; and
8) Recognize that Ms. Claudia Campbell will not seek reappointment upon the expiration of her term, effective July 3, 2026, and thank her for her civic service as a member of the Board; and
9) Appoint Ms. Mary Riser for a four (4) year term to fill the place seat formerly held by Ms. Claudia Campbell, said term to be effective July 3, 2026, and expire July 3, 2030.

BACKGROUND INFORMATION
Background: Code of Alabama 45-2-221.10 - Historic Development Commission with the following membership duties, and powers may be created by the Baldwin County Commission. (a) The Commission shall be composed of no less than 11 members who shall be selected by the County Commission in such a manner as to serve overlapping terms. Except for the first members, their term shall be four years. (b) The Commission shall operate under a constitution as adopted by the Commission and approved by the County Commission. (c) The commission shall have as its purposes: (1) The preservation and protection of buildings of historic and architectural value in the historic districts, as defined in Section 45-2-221.01, and maintenance of the distinctive character of these districts; (2) the fostering and encouraging of the preservation, restoration, and utilization of buildings of historic and architectural value in the historic districts.
The Baldwin County Commission, during its regularly scheduled meeting held on October 1, 2002, adopted and approved an amended Constitution and By-laws of the Baldwin County Historic Development Commission to provide that such a Board be composed of twelve (12) members.
Today, all members of the twelve (12) member board serve four (4) years, overlapping terms each through selection/appointment by the Baldwin County Commission, such terms beginning on the 3rd day of July in the year appointed/reappointed as specified in the Baldwin County Historic Development Commission’s Constitution and By-laws.
Staff finds that under Section 11 of Act No. 80-497, as amended by Act No. 89-960, coupled with an analysis of the Baldwin County Historic Development Commission’s Constitution and By-laws, the only requirement for appointments to such Board be that each person appointed must be a resident of Baldwin County, Alabama.
With the only qualification for members of the Baldwin County Historic Development Commission board being that all members are residents of Baldwin County, Alabama, staff asserts that the nominees are qualified to be appointed/reappointed to the Baldwin County Historic Development Commission.
