Approve the Non-Substantial Amendment No. 1 to the Community Development Block Grant - Disaster Recovery (CDBG-DR) Local Recovery Plan (LRP) for submission to the Alabama Department of Economic and Community Affairs (ADECA).

BACKGROUND INFORMATION

Background:  On February 18, 2025, the Baldwin County Commission received formal approval from the Alabama Department of Economic and Community Affairs (ADECA) for its Local Recovery Plan (LRP) under the HUD CDBG-DR program. This approval authorized Baldwin County to proceed with implementation of recovery activities addressing unmet housing, infrastructure, economic development, and mitigation needs resulting from Hurricanes Sally and Zeta.

This amendment qualifies as a non-substantial amendment under the LRP (Section 3.3) because it does not modify program beneficiaries or eligibility, adjust program budgets by more than 10%, or add or remove any activities. Non-substantial amendments may be made at the County’s discretion and do not require a public comment period. In accordance with the County’s CDBG-DR Citizen Participation Plan, Baldwin County is required to publish non-substantial amendments on the Baldwin County Commission CDBG-DR website and provide notice to ADECA. These amendments become effective five (5) days after being posted online.

Amendments to the Local Recovery Plan:

1) Local Recovery/CDBG-DR budget: Amendment 2 of the Subrecipient Agreement between the State of Alabama and Baldwin County Commission provided an update to the overall CDBG-DR award budget and activity categories. The Amendment added an Administration activity and reallocated $50,000 from both the Housing and Non-housing Recovery Activity budgets to Administration for a total of $100,000.00.

2) Local Government Recovery Infrastructure Program (LGRIP) Change to Minimum Award Amount: LGRIP originally proposed a minimum award amount of $750,000.00. Amendment 1 decreases the LGRIP minimum award from $750,000.00 to $300,000.00.

3) Homeownership Assistance Program (HAP) Change to Program Method of Distribution: Program administration and delivery of services for HAP was originally to be managed by the Baldwin County Grants Department. Amendment 1 updates the program delivery so that HAP will be administered by program partner(s) in coordination with Baldwin County Commission.
