Recommendation

Take the following actions:

 

1) Approve the following Community Development Block Grant - Disaster Recovery (CDBG-DR) Local Government Recovery Infrastructure Program (LGRIP) projects:

 

                     City of Daphne - Randall Avenue Drainage Improvements - $1,581,883.00

                     City of Robertsdale - Sanitary Sewer and Drainage Rehabilitation - $800,000.00

                     City of Loxley - Sanitary Sewer Rehabilitation - $809,000.00

                     East Central Baldwin Water Authority - Water Line Extension on Woerner Road - $1,235,000.00 

                     Town of Magnolia Springs - Drainage Improvements - $949,537.98

                     City of Orange Beach - Jubilee Point Road Elevation - $950,000.00

                     North Baldwin Utilities - Emergency Storage Pond Restoration - $1,000,000.00

                     City of Fairhope - Fish River Water Expansion - $2,000,000.00

                     Perdido Bay Water, Sewer and Fire Protection District - Operations and Maintenance Facility - $800,000.00

                     City of Bay Minette - Drainage Rehabilitation for McMillan Avenue Area - $2,000,000.00

 

2) Authorize staff to submit the CDBG-DR LGRIP Activity Profile Forms and supporting documents to ADECA for Funding Consideration; and

 

3) Authorize the Chairman to execute any documents related to the LGRIP Activity Profile Form submittals.

BACKGROUND INFORMATION

 

Background:  As outlined in Baldwin County’s approved Local Recovery Plan (LRP), ADECA allocated $13.3 million to LGRIP for the County to fund local municipalities (cities, towns, and utility districts) for eligible, priority infrastructure investments that address recovery from damage caused by Hurricanes Sally and Zeta, mitigate future disaster impacts, and enhance quality of life for vulnerable populations. LGRIP supports eligible projects such as roadway extensions, drainage system upgrades, flood mitigation improvements, broadband expansion, and the restoration of critical public facilities. Each project must demonstrate a direct connection to the declared disaster or contribute meaningfully to long-term mitigation efforts, while also meeting HUD’s National Objective and complying with applicable federal regulations, including 2 CFR Part 200.

 

The LGRIP Phase 2 submissions included 13 applications for disaster recovery projects, from eight municipalities and three utility providers. County staff have identified and developed eligible CDBG-DR LGRIP projects that address documented disaster-related impacts, enhance community resilience, and support critical public infrastructure needs. All required application components, including project descriptions, budgets, environmental documentation, and supporting materials, are being prepared for submission to ADECA in accordance with program guidelines.

 

                     City of Daphne - Randall Avenue Drainage Improvements

Construction of .53 miles of new pedestrian and stormwater infrastructure. Two thousand feet of roadway will be replaced with new curb and gutter, and 2,800 feet of sidewalk with ADA compliant features. New cross drain systems, sewer pipes, inlets, and outlets will be included. Traffic control, erosion, and sediment control measures will also be implemented.

 

                     City of Robertsdale - Sanitary Sewer and Drainage Rehabilitation

Rehabilitation of aging sanitary sewer mains through installation of 8,500 linear feet of sewer main and 10 manholes with Cured in Place Pipe (CIPP) liner methods, point repairs, and lateral replacements. Rehabilitation components will include CCTV inspection and cleaning prior to repairs and installations.

 

                     City of Loxley - Sanitary Sewer Rehabilitation

Rehabilitation of 6,200 linear feet of sewer main and manholes with Cured in Place Pipe Liner methods, point repairs and lateral replacements in the Chicago Avenue area.

 

                     East Central Baldwin Water Authority - Water Line Extension on Woerner Road

Installation of critical upgrades to the water distribution infrastructure. Replace and upgrade the aging and storm-damaged water main pipes along two unpaved roads. Project is in coordination with the County’s ongoing dirt road paving initiatives and will accommodate roadway improvements.

 

                     Town of Magnolia Springs - Drainage Improvements

Drainage improvements including 1,315 cubic yards of excavation to re-establish proper drainage grades, restoration of drainage culverts to improve hydraulic capacity, and the installation of improved stormwater infrastructure. The project includes top-soil placement and soil sodding to restore disturbed areas and promote vegetation stabilization.

 

                     City of Orange Beach - Jubilee Point Road Elevation

Design and construction of critical roadway improvements to Jubilee Point Road. Construction will include elevating the road 4-5 feet, installation of bulkhead walls, backfilling the area, placement of crushed aggregate base, and tying road ends together.

 

                     North Baldwin Utilities - Emergency Storage Pond Restoration

Restoration of the emergency storage pond that is responsible for catching excessive sewer flows during hurricanes and other storm events. Storage volume will be restored to two emergency ponds through removal of accumulated sediment, replacement or restoration of pond liner, and restoration of the project area.

 

                     City of Fairhope - Fish River Water Expansion

Construction of a water-main extension to create a loop and provide an alternate feed in the event of emergency or required maintenance. Upgrade the new water main loop with larger piping to increase capacity and address growing demands.

 

                     Perdido Bay Water, Sewer and Fire Protection District - Operations and Maintenance Facility

Hardening and restoration of a new 6,665 square foot building that will serve as the Perdido Bay Water, Sewer & Fire Protection District’s Operations and Maintenance Facility. This facility will include a large work area, supply area, metal shelving, worktables, materials testing areas, utility room, bathroom, breakroom, equipment storage area, grease drums and welding station, and adequate outside covered workspace. The facility will serve as both a dispatch point for repair crews and a hub for emergency response during storm events.

 

                     City of Bay Minette - Drainage Rehabilitation for McMillan Avenue Area

Installation and rehabilitation of 26,350 linear feet of drainage facilities, including drainage ditches and 48” class storm drainpipe in the McMillan Avenue area. Rehabilitation includes excavation of excess material and the development of concrete structures to address overtopping of open drainage ditches.

 

Previous Commission action/date: 

January 20, 2026 - Approved the Non-Substantial Amendment No. 1 to the CDBG-DR LRP for submission to ADECA.

 

January 6, 2026 - Approved the submittal of the CDBG-DR CPIP Activity Profile Form for the County Road 65 Extension Project from County Road 34 to County Road 36 by staff to ADECA CDBG-DR grant portal; and authorized the Chairman to sign any documents related to this Activity Profile Form; and approve the submittal of the CDBG-DR HAP Activity Profile Form, by staff to ADECA CDBG-DR grant portal; and authorized the Chairman to sign any documents related to this Activity Profile Form; and approved the submittal of the CDBG-DR LGRIP Activity Profile Form by staff to ADECA CDBG-DR grant portal; and authorized the Chairman to sign any documents related to this Activity Profile Form.

 

November 6, 2025 - Awarded the Contract to MB3 Inc. d/b/a Civix in the amount of $2,427,488.00 for the Implementation Phase of the General Grant and Management, Project Management, and Capacity Building for CDBG-DR Subaward and authorize the Chairman to execute the Contract contingent upon County Attorney approval. (The contract is effective on the date of full execution.)

 

September 16, 2025 - Approved the submittal of CDBG-DR CPIP Activity Profile Form for the CR 65 Extension Project from CR 28 to CR 32, by staff to ADECA CDBG-DR grant portal; and authorized the Chairman to sign any documents related to this Activity Profile Form.

 

August 19, 2025 - Approved the formal administrative closeout of the CDBG-DR Planning Phase; and approved the Budget Director to remove the remaining available balance of $332,989.24 from the CDBG-DR Planning Phase ledger. These funds were not reimbursed and are not eligible for retention or reallocation.

 

July 1, 2025 - Approved Amendment No. 2 to Subrecipient Agreement Number DR-21-001 between the BCC and the State of Alabama, ADECA, addressing recovery from Hurricanes Sally and Zeta, including unmet housing, infrastructure, economic development, mitigation, and other eligible unmet needs, as described in the BCC’s approved LRP. Amendment No. 2 to Baldwin County’s CDBG-DR Subrecipient Agreement with ADECA establishes the implementation budget allocations of $100,000.00 for Administration, $19,169,010.00 for Housing Recovery Activities, and $24,092,676.00 for Non-Housing Recovery Activities. The amendment also extends the period of performance through October 31, 2028.

 

May 6, 2025 - Approved the Third Amendment to Contract for Professional Services with MB3 Inc. d/b/a Civix for the Planning Phase of the General Grant and Management, Project Management, and Capacity Building for the CDBG-DR Subaward.

The following clauses were added to Section 6.5 of the agreement and included in Attachment A:

The term and cost of the contract remain unaffected by this Amendment.

November 5, 2024 - Approved the First Amendment to the Contract for Professional Services with MB3 Inc. d/b/a Civix in the amount of $211,345.00 for the Planning Phase of the General Grant and Management, Project Management, and Capacity Building for the CDBG-DR Subaward.

 

September 17, 2024 - Approved Amendment No. 1 to Subrecipient Agreement Number DR-21-001 between the Baldwin County Commission and ADECA addressing recovery from Hurricanes Sally and Zeta, including unmet housing, infrastructure, economic development, mitigation, and other eligible unmet needs, as described in the BCC’s approved LRP.

 

September 3, 2024 - Adopted Resolution #2024-155 of the Baldwin County Commission approving the CDBG-DR LRP for DR-4563 and DR-4573.

 

August 20, 2024 - Adopted Resolution #2024-150 of the Baldwin County Commission approving the Baldwin County Commission CDBG-DR Language Access Plan for Limited English Proficiency Persons.

 

August 6, 2024 - Conducted a Public Hearing regarding the adoption of the CDBG-DR CPP; and following Public Hearing adopted Resolution #2024-147 of the Baldwin County Commission approving the CDBG-DR CPP.

 

March 5, 2024 - Awarded the Contract to MB3 Inc. d/b/a Civix in the amount of $370,081.00 for the Planning Phase of the General Grant and Management, Project Management, and Capacity Building for the CDBG-DR Subaward and authorized the Chairman to execute the Contract.

 

December 19, 2023 - Accepted the CDBG-DR sub-award from ADECA in the amount of $1,000,000 for the development of a LRP to identify local unmet needs resulting from Hurricanes Sally and Zeta in 2020 through outreach and coordination with impacted stakeholders; and approved the Subrecipient Agreement No. DR-21-001, with ADECA; and authorized the Chairman to execute the agreement and any related documents.

 

November 7, 2023 - Approved the RFP for General Grant Coordination and Management, Project Management, and Capacity Building for the CDBG-DR Subaward and authorized the Purchasing Director to advertise the RFP; and authorized the Chairman/Purchasing Division Commissioner for the BCC to approve any necessary addendums or clarifications if required after the RFP is advertised.

 

November 16, 2022 - Authorized staff to proceed with preparing a Request for Proposals (RFP) document for the development of the CDBG-DR Local Recovery Plan for Baldwin County.

 

October 4, 2022 - Approved and authorized the Chairman to execute a letter to ADECA providing comments in response to the CDBG-DR Draft Action Plan.
