STAFF RECOMMENDATION
Recommendation
Approve and authorize the Chairman to execute the Alabama Department of Youth Services (DYS) Part 1 and Part 2 Grant/Subsidy and Reimbursement Agreement for FY 2027 and any related documents which:
1) Awards the Baldwin County Regional Juvenile Detention Center (JDC) $14,000.00 per county for providing six (6) counties at a minimum of one (1) bed per county for a total of $84,000.00 for the following counties:
Baldwin, Choctaw, Conecuh, Escambia, Monroe, and Washington
2) Awards the JDC $109,067.00 based on 2020 United States Census.
3) Reimburses the County for the cost of juveniles not accepted within the prescribed number of days pursuant to Alabama Code 12-15-215 (k). The Alabama DYS agrees to pay the County $120.00 daily per diem expenses incurred for each day after DYS is required to accept juveniles for commitment.

BACKGROUND INFORMATION
Background: The Baldwin County Regional Juvenile Detention Center, in correlation with Alabama DYS, provides a safe and secure environment for juveniles accused of committing criminal action or who pose a risk to public safety, pending adjudication by the court. The Grant/Subsidy amount incorporates the distribution formula as required by Legislative Act 2026-383. As per Alabama Code § 12-15-215(k) the Alabama DYS will reimburse the Baldwin County Commission a per diem rate of $120.00 per day for juveniles not placed in court ordered programs within the 12-day agreed upon time frame.
Previous Commission action/date: 11/06/2025 - Approved and authorized the Chairman to execute the Alabama Department of Youth Services Grant/Subsidy and Reimbursement Agreement for FY 2026.
