STAFF RECOMMENDATION
Recommendation
Approve an Intergovernmental Roadway Construction Agreement between the Baldwin County Commission and the Town of Magnolia Springs to construct approximately 2,600 feet of roadway and pedestrian improvements on County Road 49 from U.S. Route 98 southward.
The Town of Magnolia Springs will continue to maintain this segment of roadway after the project is completed.

BACKGROUND INFORMATION
Background: The Town of Magnolia Springs and the Baldwin County Commission have determined that various multimodal improvements on County Road 49 are necessary to improve roadway capacity and pedestrian safety. These two goals will be achieved through a combination of access management, center turn lanes, and a detached multi-use pathway. The project will begin at U.S. Route 98 and end approximately 2,600 feet southward at Magnolia River.
The County Road 49 project will be the third project of the Baldwin County Commission’s 30 Cubed Program, which is aimed at fostering collaboration with municipalities across the county to reduce traffic congestion on our shared roadway systems. The County Commission has designated thirty million dollars ($30M) to be matched with thirty million dollars ($30M) of municipal funding for transportation projects that are focused on improving roadway capacity and connectivity throughout Baldwin County. The Commission’s goal is to have $60 Million in transportation projects constructed, under construction, or under contract by 2030. The $30M provided by the County, $30M by Municipalities, by year 2030, is 30 by 30 by 30, becoming the 30 Cubed Program.
The total estimated cost of the County Road 49 project is $4,200,000.00 with the Town funding $2,100,000.00 (50%) and the County funding the remaining $2,100,000.00 (50%). Eligible project costs include right-of-way acquisitions, design, utility relocations, permitting, construction, and construction engineering and inspection (CE&I). The Town agrees to utilize Town employee time and resources to facilitate designing the project, facilitate right-of-way acquisitions, coordinate utility relocations, and facilitate the CE&I required to construct the project. The Town of Magnolia Springs agrees that it shall let the project out for public bid, continue maintenance of the right-of-way containing the project and responsibility for maintenance of County Road 49 located within the project after the completion of construction.
The County shall tender payment to the Town equal to half (50%) of the total costs, fees, and expenses of the project, including all costs incurred for design, utility relocations, right-of-way acquisitions, permitting, construction, and CE&I.
