STAFF RECOMMENDATION

Recommendation

Take the following actions:

 

1) Approve the eligible uses and authorize the expenditures of $39,279.20 in Local Assistance and Tribal Consistency Funds (LATCF) and $3,046.24 in American Rescue Plan Act (ARPA) interest for the below projects; and

 

2) Authorize the Purchasing Director to issue a Purchase Order to Wittichen Supply Co. in the amount of $6,447.48 for the purchase of air purifiers and scrubbers in the Bay Minette Courthouse with LATCF; and

 

3) Authorize the Purchasing Director to issue a Purchase Order to Trane Supply Inc., in the amount of $2,324.00 for the purchase of thermostats in the Bay Minette Courthouse with LATCF; and

 

4) Authorize the Accounting Manager to reclass the expenses to Stewart Precision Coatings from Purchase Order Nos. 2026-1149, 2026-1152, 2026-1175, and 2026-1507 in the total amount of $28,450.00 for the painting services at the Bay Minette Courthouse with LATCF; and

 

5) Authorize the CIS Department to issue a Purchase Order to Vision Security Technologies in the amount of $5,103.96 for the purchase of four access-control doors in the Foley Satellite Courthouse with $2,057.72 in LATCF and $3,046.24 of interest earned from ARPA funds.

BACKGROUND INFORMATION

 

Background:  Please note, File ID #26-0701 on this agenda is for approval of Resolution #2026-088 for the allocation of funds from the Local Assistance and Tribal Consistency Funds (LATCF) to support various courthouse facility improvements.

 

The Local Assistance and Tribal Consistency Fund (LATCF) provides flexible federal funding to counties for governmental purposes, including facility improvements, maintenance, and public-facing infrastructure. The County also continues to earn interest on American Rescue Plan Act (ARPA) allocations, which may be used for eligible governmental expenditures. The projects listed in this item qualify as allowable uses of LATCF and ARPA interest and support the County’s ongoing efforts to maintain safe, functional, and secure public facilities.

 

The County has identified several facility and operational needs within the Bay Minette Courthouse and the Foley Satellite Courthouse that support continued public access, safety, and building functionality. These needs include the replacement of aging thermostats, the installation of air purifiers and scrubbers to improve indoor air quality, painting and maintenance of interior spaces, and the installation of access-control doors to enhance building security.

 

Previous Commission action/date: 

August 19, 2025 - BCC adopted Resolution #2025-162, allocating ARPA and Revenue Replacement interest to the Capital Projects Fund.

 

April 1, 2025 - BCC approved the quote from Tindle Construction in the amount of $45,630.00 for Renovations of Courtroom No. 1 located on the first floor of the Bay Minette Courthouse and authorize the Chairman to execute the Contract and Certificate of Compliance; and authorized the Purchasing Director to issue a Purchase Order to Delta Flooring in the amount of $16,587.00 for the installation of new carpet in Judge Scott Taylor’s office suite area; and authorized the use of LATCF balance in the total amount of $62,217.00 for both projects.

 

December 3, 2024 - BCC rescinded action taken by the Baldwin County Commission during its June 18, 2024, Regular Meeting (Agenda Item CN2) which adopted Resolution #2024-123 allocating $400,000.00 in ARPA Revenue Replacement funds; and approved the allocation of interest earned from ARPA funds in the amount of $395,297.00 for the engineering design professional services of the Scenic Highway 98 Bridge Replacement Project in Point Clear; and adopted Resolution #2025-051 of the BCC allocating up to $395,297.00 of interest earned from ARPA funds for the engineering design professional services of the Scenic Highway 98 Bridge Replacement project. BCC approved the allocation of interest earned from ARPA funds in the amount of $697,359.61 for the construction costs of the Sally Port Project that exceeded the County’s $10,000,000 Revenue Replacement allocation; and adopted Resolution #2025-052 of the BCC allocating up to $697,359.61 of interest earned from ARPA funds for a portion of the construction costs of the Sally Port Project.                        

 

November 5, 2024 - BCC adopted Resolution #2025-029, allocating ARPA and Revenue Replacement interest in the amounts of $2,502,970.00 and $723,010.00, respectively, with said allocations being distributed as follows:

 

$ 925,980.00 Capital Projects Fund

$ 1,000,000.00 Self Insurance Fund

$ 1,300,000.00 Revenue Replacement Fund Projects

 

February 6, 2024 - BCC rescinded the following actions taken by the BCC during regularly scheduled meetings regarding the allocation of American Rescue Plan Act (ARPA) funds to cover legal costs incurred by the BCC through Stone Crosby, P.C.:

April 4, 2023 (Agenda Item GA1) for the period of January 1, 2023, through March 31, 2023, in the amount of $12,135.33.

 •August 1, 2023 (Agenda Item GA1) for the period of April 1, 2023, through June 30, 2023, in the amount of $2,092.50.

 •November 21, 2023 (Agenda Item CN1) for the period of July 1, 2023, through September 30, 2023, in the amount of $1,867.50; and approved the allocation of ARPA funds (299.44881) in the amount of $9,999.99 to cover Legal Services (29970010.51540) incurred by the BCC through Stone Crosby, P.C. from January 1, 2023, through March 31, 2023; and approved the allocation of interest earned from ARPA funds (299.47100) in the amount of $7,209.09 to cover Legal Services (29929910.51540) incurred by the BCC through Stone Crosby, P.C. that exceeded the federal micro-purchase procurement threshold from January 1, 2023, through December 31, 2023.                         

 

January 17, 2023 - BCC approved the allocation of interest earned from the ARPA funds in the amount of $10,084.00 to East Central Baldwin County Water, Sewer, and Fire Protection Authority for the Lehman Road project; and approved payment to the East Central Baldwin County Water, Sewer, and Fire Protection Authority in the amount of $10,084.00 for the Lehman Road Project; and adopted Resolution #2023-039 of the BCC allocating up to $10,084.00 of interest earned from the ARPA funds to East Central Baldwin County Water, Sewer, and Fire Protection Authority for the Lehman Road project.             

 

December 20, 2022 - BCC approved the allocation of interest earned from the ARPA funds in the amount of $12,084.00 to East Central Baldwin County Water, Sewer, and Fire Protection Authority for the Lehman Road project; and approved payment to the East Central Baldwin County Water, Sewer, and Fire Protection Authority in the amount of $12,084.00 for the Lehman Road Project; and adopted Resolution #2023-039 of the BCC allocating up to $12,084.00 of interest earned from the ARPA funds to East Central Baldwin County Water, Sewer, and Fire Protection Authority for the Lehman Road project. BCC approved the allocation of interest earned from the ARPA funds in the amount of $109,967.18 to reimburse the General and Other Departmental Funds for the ineligible employees’ Temporary Premium Payments; and approved the Finance and Accounting Department to apply ARPA interest earned to the General and Other Departmental Funds; and adopted Resolution #2023-040 of the BCC allocating up to $109,967.18 to reimburse the General and Other Departmental Funds for the ineligible employees’ Temporary Premium Payments.
