STAFF RECOMMENDATION

Recommendation

Approve License Agreement #24022 permitting R and P Development, LLC, to install 40 feet of 54-inch reinforced concrete pipe across unmaintained right-of-way on Ray Gardner Lane in Foley, Alabama.

The term of this agreement shall commence on the date of full execution. License for installation shall terminate at 11:59 p.m. on January 31, 2025. License for maintenance shall be indefinite according to the terms of the agreement.

BACKGROUND INFORMATION

 

Background:  R and P Development, LLC, desires to install 40 feet of 54-inch RCP across Baldwin County unmaintained right-of-way on Ray Gardner Lane.  Any damage to private property or county right-of-way shall be repaired to the previous state or improved as required by Baldwin County.  Appropriate erosion and sediment control practices shall be utilized, and no clearing shall take place. All improvements constructed by Licensee shall be maintained by the Licensee for any and all portions of the property that is not County maintained. The Licensee shall have the property surveyed and staked prior to performing work. Any further development shall not be allowed until a new agreement is obtained.
