Resolution #2027-027 - Reallocation of ARPA Funds for Public Works Projects
End
STAFF RECOMMENDATION
Recommendation
Adopt Resolution #2027-027 of the Baldwin County Commission in order to reallocate ARPA funds.
End
BACKGROUND INFORMATION
Background: Resolution forthcoming from staff.
The U.S. Department of the Treasury released updated guidance on the reobligation of State and Local Fiscal Recovery Funds (SLFRF) from the American Rescue Plan Act (ARPA) funds on November 9, 2023. If a project funded by the ARPA SLFRF is completed with total project expenditures less than the approved budgeted obligation, the remaining funds can be reallocated to other eligible projects that were obligated by the December 31, 2024, reporting deadline. This item seeks to maximize eligible ARPA usage by redistributing unspent balances from closed or near-completion projects to priority needs while ensuring timely compliance with federal expenditure deadlines.
The Baldwin County Commission will consider a resolution to reallocate remaining American Rescue Plan Act (ARPA) and Revenue Replacement funds from multiple completed or substantially completed projects. These reallocations fall into two primary categories:
1. Reallocations to Support Drainage Improvement Project Change Orders:
Surplus funds from several completed HVAC installations and drainage projects are proposed to be reassigned to cover outstanding change orders for the Sherman Road and River Road Drainage Improvements projects. This includes funds remaining from the Board of Education Building HVAC project, the Fairhope Satellite Courthouse HVAC project, and multiple balances from the Surfside Drive Drainage Improvements project. Additionally, a portion of the Miscellaneous Protective Partitions project balance would be redirected to help meet related drainage project needs.
3. Reallocations to Reimburse ARPA Interest Costs:
The Commission will also consider reallocating contingency funds from the Construction of the New Sally Port at the Baldwin County Courthouse to reimburse ARPA interest charges incurred in connection with the Scenic Highway 98 bridge replacement project.
