STAFF RECOMMENDATION

Recommendation

Take the following actions:

1) Approve License Agreement #25007 permitting Point Broadband Fiber Holding, LLC, to install fiber optic cable on the following unmaintained rights-of-way in Foley and Gulf Shores, Alabama:

Pine Acres Road - 381 feet

Daniel Styron Lane - 1,162 feet

Helton Drive - 70 feet

Sims Drive - 250 feet

 

2) Authorize the County Engineer to execute Utility Permit #25201-F.

The term of this Agreement shall commence on the date of full execution. License for installation shall terminate at 11:59 p.m. on October 31, 2025. License for maintenance shall be indefinite according to the terms of the Agreement.

BACKGROUND INFORMATION

 

Background:  Point Broadband Fiber Holding, LLC, desires to install fiber optic cable within the unmaintained rights-of-way on Pine Acres Road, Daniel Styron Lane, Helton Drive, and Sims Drive. (The Baldwin County Utility Permit Guidelines shall be utilized in pursuit of the attached Utility Permit #25201-F. Any damage to private property or County right-of-way shall be repaired to the previous state or improved as required by Baldwin County. Appropriate erosion and sediment control practices shall be utilized, and no clearing shall take place.) Any further development shall not be allowed until a new agreement is obtained.
