STAFF RECOMMENDATION

Recommendation

Approve a payment of $10,914.42 to former Baldwin County Commissioner Joseph L Davis III, to reconcile a documented compensation error, for the period of November 2018 through July 2022.

BACKGROUND INFORMATION

 

Background:  Act 2017-324 and Section 45-2-70.01 of the Code of Alabama states in part "(a) In Baldwin County, effective beginning the next term of office, the annual basic compensation of each member of the county commission shall be an average of the median annual household income in Baldwin County for the previous four years as ascertained and adjusted each four-year term by the State Department of Labor to take effect on the first day of November the first year of each four-year term and to be payable in equal monthly installments from the general fund of the county."

 

On September 7, 2018, the Alabama Department of Labor issued a letter to the County stating that pursuant to the provisions of Act 2017-324, the Secretary of the Department of Labor certified that the average median annual household income of Baldwin County for the latest available years of 2013-2016, was $51,221.25.

 

In an updated letter issued September 14, 2026, the Secretary of the Alabama Department of Workforce, formerly the Department of Labor, certified that the average median annual household income for Baldwin County was $54,131.75, for the corrected years of 2014-2017.
