Recommendation
Approve an Intergovernmental Roadway Construction Agreement between the Baldwin County Commission and the City of Foley to construct approximately 5,280 feet of new roadway and pedestrian improvements extending James Road from Brinks Willis Road southward.
The City of Foley will assume responsibility for maintenance after the project is completed.

BACKGROUND INFORMATION
Background: The City of Foley and the Baldwin County Commission have determined that roadway and pedestrian improvements to extend James Road from Brinks Willis Road, southward approximately 5,280 feet, are necessary to (i) improve road capacity and connectivity for the citizens and residents of Foley, Gulf Shores, and the County, and (ii) promote the safety, convenience, order, prosperity and welfare of the citizens and residents of the Cities and the County.
The total estimated cost of the project is $4,200,000.00 with the City funding $2,100,000.00 (50%) and the County funding the remaining $2,100,000.00 (50%). Eligible project costs include right-of-way acquisitions, design, utility relocations, permitting, construction, and construction engineering and inspection (CE&I). The City agrees to utilize City employee time and resources to facilitate designing the project, facilitate right-of-way acquisitions, coordinate utility relocations, and facilitate the CE&I required to construct the project. The City of Foley agrees that it shall let the project out for public bid, accept the right-of-way containing the project and be responsible for maintenance of James Road located within the project after the completion of construction.
The County shall tender payment to the City equal to half (50%) of the total costs, fees, and expenses of the project, including all costs incurred for design, utility relocations, right-of-way acquisitions, permitting, construction, and CE&I.
The James Road project will be the second project of the Baldwin County Commission’s 30 Cubed Program which is aimed at fostering collaboration with municipalities across the county to enhance the capacity and connectivity of our roadway system. The County Commission is designating thirty million dollars ($30M) to be matched with thirty million dollars ($30M) in municipal funding for various types of capacity and connectivity transportation projects throughout Baldwin County. The goal is to have $60 Million of these projects constructed, under construction, or under contract by 2030. So $30M by County, $30M by Municipalities, by 2030 is 30 by 30 by 30, becoming the 30 Cubed Program.
The 30 Cubed Program Projects will be for County or Municipal roadways that provide regional significance to new roadway network connectivity or significantly enhance the capacity of an existing roadway. This program is not intended for roadway maintenance items such as resurfacing, drainage work, or other items that do not significantly enhance traffic capacity.
