STAFF RECOMMENDATION

Recommendation

Adopt Resolution #2025-087 which approves the amendments to the Baldwin County Zoning Ordinance text and the Baldwin County Zoning Map as advertised and found in Attachment “A” and Attachment “B”.

BACKGROUND INFORMATION

 

Background:  Over the past several months, it has been brought to Planning & Zoning staff’s attention that the Official Zoning Map may contain some areas that require updates due to changes in conditions and public policy. Additionally, several Articles of the adopted Baldwin County Zoning Ordinance have been identified that contain unclear or contradicting language that does not align with the current land use policies and development trends.

 

In accordance with Article 19 of the Baldwin County Zoning Ordinance, the Baldwin County Commission passed a motion authorizing Planning and Zoning staff to draft amendments to the Official Baldwin County Zoning Map and Baldwin County Zoning Ordinance.  A summary of the amendments can be found in the attached Staff Report and the complete version of the draft amendments can be found in Attachment “A” and Attachment “B”.

 

On March 6, 2025, the Baldwin County Planning and Zoning Commission held a public hearing during the regularly scheduled meeting. The Baldwin County Planning and Zoning Commission voted 6-0 to recommend approval of the draft amendments with the following changes:

 

1) The Public Notice-Public Meeting (Section 19.16) procedure currently codified in the ordinance will remain unchanged.

 

2) Notice of County Commission action on rezoning cases will be sent to the Planning Commission members after the County Commission meetings (add to Section 19.16).

 

3) Parking for single family dwellings / duplexes will be 3 spaces (Section 15.2).

 

Previous Commission action/date:  11/05/2024 - BCC passed a motion authorizing the Planning and Zoning staff to draft proposed amendments to the Official Baldwin County Zoning Map and Baldwin County Zoning Ordinance.
