STAFF RECOMMENDATION
Recommendation
As related to the Alabama Inter-Local Mutual Aid Agreement, take the following actions:
1) Adopt Resolution #2026-034, authorizing participation in the Alabama Inter-Local Mutual Aid Agreement and designating the Baldwin County EMA Director (or designee) as the County’s representative and administrator for implementation and coordination of mutual aid under the Agreement; and
2) Approve and authorize the Chairman to execute the Alabama Inter-Local Mutual Aid Omnibus Agreement allowing Baldwin County to participate with other counties and municipalities in providing and receiving reciprocal aid and assistance pursuant to Act 2025-206.

BACKGROUND INFORMATION
Background: Summary of Act 2025-206 (see attached):
Alabama Act No. 2025-206 amended §§31-9-9 and §31-9-11 of the Code of Alabama to expand the scope in which local jurisdictions may enter into mutual aid agreements with public or private agencies to protect public health and safety, and to preserve life and property during emergencies or events. The Act further provides that employees of political subdivisions retain the same powers and immunities when acting outside their jurisdiction pursuant to a mutual aid agreement.
Participation in the Alabama Inter-Local Mutual Aid Omnibus Agreement is voluntary, and the County may accept or decline assistance requests based on available resources and operational needs. The Agreement enables Baldwin County to provide or receive aid in the form of equipment, supplies, personnel, and other support during emergencies or events “too great to be dealt with unassisted.” It also allows mutual aid for planned events, training, and exercises.
Adoption of the accompanying Resolution will designate the Baldwin County EMA Director (or designee) as the County’s representative and administrator for implementation and coordination of mutual aid under the Agreement.
