STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Rescind the action taken by the Baldwin County Commission during its regularly scheduled meeting on September 5, 2023, more specifically, the Staff recommendation regarding Agenda item CO5, which approved as follows:
“Approve a Supplemental Utility Agreement between the Baldwin County Commission and Riviera Utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this supplemental relocation work is $94,564.53 with the Alabama Department of Transportation (ALDOT) providing $85,108.08 (90%) and Baldwin County providing $9,456.45 (10%). (This agreement shall be effective upon full execution and will terminate upon completion of the project.)”
2) Approve a Supplemental Utility Agreement between the Baldwin County Commission and Riviera Utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this supplemental relocation work is $95,014.53 with the Alabama Department of Transportation (ALDOT) providing $85,513.07 (90%) and Baldwin County providing $9,501.46 (10%). (This agreement shall be effective upon full execution and will terminate upon completion of the project.)

BACKGROUND INFORMATION
Background: This supplemental agreement was approved on September 5, 2023. An error in the agreement amount was found before it was executed by the Alabama Department of Transportation (ALDOT). A corrected agreement will be executed in its place.

September 5, 2023 - Approved a Supplemental Utility Agreement between the Baldwin County Commission and Riviera Utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this supplemental relocation work is $94,564.53 with the Alabama Department of Transportation (ALDOT) providing $85,108.08 (90%) and Baldwin County providing $9,456.45 (10%). (This agreement shall be effective upon full execution and will terminate upon completion of the project.)
May 17, 2022 - Approved a Reimbursable Utility Agreement between the Baldwin County Commission and Riviera Utilities for the relocation of utilities to complete the Highway Safety Improvement Project (HSIP) Roundabout Project at County Road 13 and County Road 44. Total cost of this relocation is $137,278.26 with the Alabama Department of Transportation (ALDOT) providing a 90% match of $123,550.43 and Baldwin County providing the remaining 10% of $13,727.83 (This agreement shall be effective upon full execution and will terminate upon completion of the project.)
FINANCIAL IMPACT
Total cost of recommendation: $95,014.53 - Of this amount, the Alabama Department of Transportation (ALDOT) is providing a 90% match ($85,513.07) and Baldwin County is providing the remaining 10% ($9,501.46.)
