STAFF RECOMMENDATION

Recommendation

Upon completion of the public hearing and consideration of comments (if any), adopt Resolution #2026-076 approving the request of the property owner for the County Commission to assess its property and the method of determining such assessments, as set forth in the petition by the Point Clear Club Improvement District, Point Clear Club Land, LLC, and Point Clear Club Investments, LLC, with respect to such request for assessment.

BACKGROUND INFORMATION

 

Background:  Chapter 11-99A known as the “Alabama Improvement District Act” has been utilized throughout the state for commercial and mixed-use developments with the intent of providing a financing vehicle for infrastructure and improvements to encourage quality projects.

 

Daniel Realty Company, LLC and the McLean Family are developing approximately 550 acres, a large portion of which was previously owned by a high-density homebuilder with plans for a large residential subdivision, for a low-density residential club and golf course to be developed in phases which are planned to include multiple green spaces.

 

At this time, The Point Clear Club Improvement District is requesting the County Commission to consider a petition and adopt a resolution approving the Assessment Methodology described in the Petition to provide for the assessment of un-platted land within the District.

 

Daniel Realty Company, LLC and the McLean Family are not asking the County for any financial assistance of any kind and are paying 100% of the cost of the development through their own sources. 

 

Previous Commission action/date:  On February 3, 2026, the County Commission approved the formation of an improvement district under Chapter 11-99A to finance certain utility and transportation infrastructure for the development. Portions of the project are expected to be dedicated to and then owned, operated, and maintained by the City of Fairhope and the Alabama Department of Transportation.

 

The Commission took the following actions: 

 

1) Adopt Resolution #2026-048, approving a Written Petition for Authority to Incorporate an Improvement District in Baldwin County, Alabama, which hereby finds and determines that the written petition by Point Clear Club Land, LLC has been duly made and filed with the County, that such written petition was signed by the authorized representative of the Owner and that the petition properly requests the necessary authority to incorporate an improvement district “The Point Clear Club Improvement District” under Chapter 99A of Title 11 of the Code of Alabama 1975, as amended. 

2) Appoint the following initial members of The Point Clear Club Improvement District Board of Directors:
