STAFF RECOMMENDATION
Recommendation
Take the following actions:
1) Adopt Resolution #2025-056 of the Baldwin County Commission approving Amendment #1 to the Subrecipient Agreement with the Town of Summerdale for the ARPA-funded Water Tower Project; and
2) Approve and authorize the Chairman to execute Amendment #1 to the Subrecipient Agreement with the Town of Summerdale.
The period of performance for this Agreement shall begin on the date of execution of the Agreement by both parties and shall end upon the completion of the project or on February 28, 2026.

BACKGROUND INFORMATION
Background: The Final Rule issued by the U.S. Department of Treasury on January 6, 2022, identified the cost of expenses for necessary investments in water infrastructure as an eligible enumerated expense.
The Town of Summerdale requested ARPA funds to assist with the funding of the construction of a new adequately sized water tank to address an immediate need to provide water to existing residents within the service area, as well as future residents. The Town is struggling to maintain a 24-hour reserve of potable water. The project would be eligible under the State and Local Fiscal Recovery Funds (SLFRF) expenditure category of 5.14, Drinking Water, Storage.
Previous Commission action/date: A summary of previous Commission ARPA action is attached.
June 6, 2023 - BCC approved the following: 1) Adopted Resolution #2023-130 of the Baldwin County Commission allocating up to $1,000,000.00 of ARPA funds to the Town of Summerdale for a Water Tower Project; and 2) Approved and authorized the Chairman to execute the Agreement between the BCC and the Town of Summerdale, contingent on acceptance and execution by the municipality.
