Recommendation

Adopt Resolution #2027-008 of the Baldwin County Commission, which approves the Non-Substantial Amendment No. 2 to the Community Development Block Grant - Disaster Recovery (CDBG-DR) Local Recovery Plan (LRP) for submission to the Alabama Department of Economic and Community Affairs (ADECA).

BACKGROUND INFORMATION

 

Background:  On February 18, 2025, the Baldwin County Commission received formal approval from ADECA for its LRP under the HUD CDBG-DR program. This approval authorized the Baldwin County Commission to proceed with implementation of recovery activities, addressing unmet housing needs, infrastructure, economic development, and mitigation needs resulting from Hurricanes Sally and Zeta.

 

This Amendment qualifies as a non-substantial amendment under the LRP (Section 3.3) because it does not modify program beneficiaries or eligibility, adjust program budgets by more than 10%, or add or remove any activities. Non-substantial amendments may be made at the County’s discretion, and do not require a public comment period. In accordance with the County’s CDBG-DR Citizen Participation Plan, Baldwin County Commission is required to publish non-substantial amendments on the Baldwin County Commission CDBG-DR website and provide notice to ADECA. These amendments become effective five (5) days after being posted online.

 

Amendment No. 2 to the Baldwin County LRP makes two specific changes. First, it establishes a maximum award amount for the Local Government Recovery Infrastructure Program (LGRIP), setting a cap of $2,000,000 whereas previously there was no limit. The minimum award amount of $300,000 remains unchanged. Second, the amendment introduces a new requirement that all LGRIP projects must include a minimum contribution equal to five percent of total project costs from non-CDBG-DR funds. These external funds must come from DR and state, or other federal sources, may not duplicate costs covered by CDBG-DR, and must be documented through a resolution or commitment from the entity submitting the project.

 

Previous Commission action/date: 

January 20, 2026 - Approved the Non-Substantial Amendment No. 1 to the Community Development Block Grant - Disaster Recovery (CDBG-DR) Local Recovery Plan (LRP) for submission to the Alabama Department of Economic and Community Affairs (ADECA).

 

November 6, 2025 - Awarded the Contract to MB3 Inc. d/b/a Civix in the amount of $2,427,488.00 for the Implementation Phase of the General Grant and Management, Project Management, and Capacity Building for CDBG-DR Subaward and authorize the Chairman to execute the Contract contingent upon County Attorney approval. (The contract is effective on the date of full execution.)

 

July 1, 2025 - Approved Amendment No. 2 to Subrecipient Agreement Number DR-21-001 between the BCC and the State of Alabama, ADECA, addressing recovery from Hurricanes Sally and Zeta, including unmet housing, infrastructure, economic development, mitigation, and other eligible unmet needs, as described in the BCC’s approved LRP. Amendment No. 2 to Baldwin County’s CDBG-DR Subrecipient Agreement with ADECA establishes the implementation budget allocations of $100,000.00 for Administration, $19,169,010.00 for Housing Recovery Activities, and $24,092,676.00 for Non-Housing Recovery Activities. The amendment also extends the period of performance through October 31, 2028.

 

September 17, 2024 - Approved Amendment No. 1 to Subrecipient Agreement Number DR-21-001 between the Baldwin County Commission and ADECA addressing recovery from Hurricanes Sally and Zeta, including unmet housing, infrastructure, economic development, mitigation, and other eligible unmet needs, as described in the BCC’s approved LRP.

 

September 3, 2024 - Adopted Resolution #2024-155, approving the Baldwin County LRP for DR-4563 and DR-4573.
