STAFF RECOMMENDATION

Recommendation

Take the following actions:

 

1) Approve the reallocation of American Rescue Plan Act (ARPA) funds in the amount of $8,677.00 from the Board of Education HVAC Project to cover the costs of Change Order #1 for the Foley Satellite Courthouse HVAC; and

 

2) Approve the reallocation of ARPA funds in the amount of $7,073.00 from the Board of Education HVAC Project to cover the costs of Change Order #1 for Project No. HW23092 - Drainage Improvements on CR-68; and

 

3) Approve the reallocation of ARPA funds in the amount of $10,232.25 from the Fairhope Satellite Courthouse HVAC Project to cover the costs of Change Order #1 for Project No. HW23092 - Drainage Improvements on CR-68; and

 

4) Approve the reallocation of ARPA funds in the amount of $10,000.00 from the Construction of Miscellaneous Protective Partitions Project to cover the costs of Change Order #1 for Project No. HW23092 - Drainage Improvements on CR-68; and

 

5) Adopt Resolution #2025-158 of the Baldwin County Commission allocating such ARPA funds for the aforementioned Public Works projects.

BACKGROUND INFORMATION

 

Background:  The U.S. Department of the Treasury released the updated guidance on the reobligation of State and Local Fiscal Recovery Funds (SLFRF) from the American Rescue Plan Act (ARPA) funds on November 9, 2023. If a project funded by the ARPA SLFRF is completed with total project expenditures less than the approved budgeted obligation, the remaining funds can be reallocated to other eligible projects that were obligated by the December 31, 2024, reporting deadline.

On March 18, 2025, the BCC approved the credited changed order and authorized the Chairman to execute Change Order #1 with Tindle Construction, LLC, in the credit amount of ($10,232.25) on the Purchase and Installation of New HVAC Equipment for the Fairhope Satellite Courthouse, and approved and authorized the Chairman to execute Change Order #1 with Tindle Construction, LLC, in the credit amount of ($15,750.00) on the Purchase and Installation of New HVAC Equipment for the Board of Education Building. On May 6, 2025, BCC approved and authorized the Chairman to execute Change Order #1 with TripTek Construction, LLC, in the credit amount of ($10,000.00) on the Construction of Miscellaneous Protective Partitions at Various Buildings. This resulted in a remaining balance of $35,982.25 in ARPA funds, which can now be reallocated to other eligible projects.

On July 16, 2025, BCC approved and authorized the Chairman to execute Change Order #1 in the amount of $8,677.00 with Persons Services Corporation, on the Purchase and Installation of New HVAC Equipment for the Baldwin County Foley Satellite Courthouse. On May 20, 2025, BCC approved and authorized the Chairman to execute Change Order #1 in the amount of $27,657.87 with C. Thornton, Inc., for Project No. HW23092 - Drainage Improvements on County Road 68, 1900’ East of County Road 65. The available amount of $35,982.25 in ARPA funds would go to these two approved projects; $8,677.00 to the Foley Satellite Courthouse HVAC Project, and $27,305.25 to the CR-68 Draining Improvement Project.

11/05/2024 meeting: Awarded the bid for Project No. HW23092 - Drainage Improvements on CR-68, 1900’ East of CR-65 to the lowest bidder, C. Thornton, Inc., in the Bid Amount $310,606.80; Construction Time: 45 working days; and authorize the Chairman to execute the Contract.

 

08/20/2024 meeting: 1) Awarded the bid for the Purchase and Installation of New HVAC Equipment for the Board of Education Building to the lowest responsible and responsive bidder, Tindle Construction, LLC, in the bid amount of $609,200.00, Completion time: 90 Working days after materials are received; and 2) Authorized the Chairman to execute the Contract; and 2) Awarded the bid for the Purchase and Installation of New HVAC Equipment for the Fairhope Satellite Courthouse to the lowest responsible and responsive bidder, Tindle Construction, LLC, in the bid amount of $560,500.00, Completion time: 90 Working days after materials are received; and 2) Authorized the Chairman to execute the Contract.

 

07/02/2024 meeting: 1) Awarded the bid for the Miscellaneous Protective Partitions at Various Buildings to the lowest bidder, TripTek Construction, LLC, in the bid amount of $253,200.00, Construction Time: 180 days (Sundays & Holidays included); and 2) Authorized the Chairman to execute the Contract; and 3) Approved the Purchasing Director to place a competitive bid for drainage improvements on CR-68, 1900 feet east of CR-65 in Loxley, Alabama, once plans and contracts are complete; and 4) Approved the Chairman to execute any project related documents.

 

06/04/2024 meeting: 1) Approved the specifications and authorized the Purchasing Director and Architect, JMR+H Architecture, PC, to place a competitive bid for the Purchase and Installation of New HVAC Equipment at the Baldwin County Fairhope Satellite Courthouse; and 2) Further, authorized the Chairman/Purchasing Division Commissioner for the BCC to approve any necessary addendums or clarifications if required after the bid is advertised; and 3) Approved the specifications and authorized the Purchasing Director and Architect, JMR+H Architecture, PC, to place a competitive bid for the Purchase and Installation of New HVAC Equipment at the Baldwin County Board of Education located in Bay Minette; and 4) Further, authorized the Chairman/Purchasing Division Commissioner for the Baldwin County Commission to approve any necessary addendums or clarifications if required after the bid is advertised.

 

02/20/2024 meeting: 1) Approved the allocation of ARPA funds in the amount of $300,000 for the cost of the Drainage Improvements along CR-68 Project, to include the replacement and improvement of the existing stormwater system; and 2) Adopted Resolution #2024-044 of the Baldwin County Commission allocating up to $300,000 of the ARPA funds for the Drainage Improvements along CR-68 Project; and 3) Approved the Chairman to execute any project related documents.

 

04/18/2023 meeting: 1) Adopted Resolution #2023-064 of the Baldwin County Commission allocating up to $669,000.00 of ARPA funds to provide ventilation system improvements to mitigate the spread of COVID-19 at the Baldwin County Fairhope Satellite Courthouse located at 1100 Fairhope Avenue, Fairhope, Alabama; and 2) Approved and authorized the Chairman to execute the AIA Professional Services Contract with JMR+H Architecture, PC, in the amount of 8.25% of the construction cost for the design of ventilation system improvements in the Baldwin County Fairhope Satellite Courthouse; and 3) Adopted Resolution #2023-063 of the Baldwin County Commission allocating up to $1,155,000.00 of ARPA funds to provide ventilation system improvements to mitigate the spread of COVID-19 at the BCC building occupied by the Baldwin County Board of Education located at 2600 Hand Avenue, Bay Minette, Alabama; and 4) Approved and authorized the Chairman to execute the AIA Professional Services Contract with JMR+H Architecture, PC, in the amount of 8.14% of the construction cost for the design of ventilation system improvements in the BCC Building occupied by the Baldwin County Board of Education.

 

01/17/2023 meeting: Approved and authorized the Chairman to execute the Professional Services Contract with PH & J Architects, Inc., in the amount of 6.5% of the construction cost for the Design of Protective Partitions in various BCC facilities. (Funding will be from the American Rescue Plan Act (ARPA funds).
