STAFF RECOMMENDATION
Recommendation
Approve and authorize the Chairman to execute the Development Agreement between the Baldwin County Commission and Superior Wall & Paver, LLC, for funding of transportation improvements on County Road 32.
This Agreement shall be effective upon date of full execution by both parties and remain in effect until the parties have performed their respective obligations, unless earlier terminated in accordance with the Development Agreement.

BACKGROUND INFORMATION
Background: Superior Wall & Paver, LLC, has acquired property and is constructing Wellsbury Subdivision. As a condition of preliminary plat approval for the subdivision, the Developer is required to construct certain transportation improvements on County Road 32. The County intends to design and construct a larger transportation improvement project on County Road 32 and will incorporate the Developer Improvements as an integrated part of the County project. The Developer contribution was established by using the engineer’s cost estimate for the transportation improvements required for the subdivision preliminary plat.
