STAFF RECOMMENDATION

Recommendation

As related to the Baldwin County Eastern Shore Health Care Authority, appoint Dr. Ross Bishop to the place seat (Slot 1) formerly held by the late Mr. Clarence Bishop, for a pro-rata reduced six (6) year term, said term commencing January 20, 2026, and expiring April 30, 2028.

BACKGROUND INFORMATION

 

Background:  Baldwin County Eastern Shore Health Care Authority submitted correspondence to the Commission dated January 13, 2026 (attached), requesting the Commission appoint Dr. Ross Bishop to fill the place seat of his late father, Mr. Clarence Bishop. 

 

A copy of the Authority's certified resolution is required to be submitted within statutorily set time parameters and in resolution/certified form, to the Commission pursuant to §22-21-352, Code of Alabama 1975, which is found within "The Health Care Authorities Act of 1982" [codified collectively at §22-21-310, et seq., Code of Alabama 1975].

 

There are no "required qualifications" set forth in the Code section for citizens to be appointed to the Authority, however, within §22-21-316, Code of Alabama 1975, such "required qualifications" are self-imposed by the Authority through its Certificate of Reincorporation, as amended by the Authority on December 17, 2001, which requires that members be "residents of Baldwin County, Alabama."

 

Staff has verified via correspondence from Baldwin County Eastern Shore Health Care Authority that the nominee meets the eligibility requirement of being a resident of Baldwin County, Alabama.
