Recommendation
Authorize the Chairman to sign a Quitclaim Deed conveying any and all rights and title to that portion of right-of-way owned and maintained by Baldwin County on Pollard Road from County Road 64 running north approximately 9,600 feet to the south right-of-way line of Park Drive and Park Drive from Pollard Road running west approximately 7,600 feet to the east right-of-way line of U.S. Highway 98.

Background:
The City of Daphne received Transportation Alternative Program (TAP) grant funding from the Federal Highway Administration (FHWA) through the Alabama Department of Transportation (ALDOT) for a sidewalk on Pollard Road from County Road 64 to Park Drive and some distance along Park Drive (see attached map). The City of Daphne took over maintenance of this portion of Pollard Road and Park Drive sometime around 1988. ALDOT requires grant recipients to certify that they own the property on which a project will be built and to prove that it was acquired in accordance with applicable federal law. As part of the certification process, it was discovered that the right-of-way was never deeded to the City by Baldwin County. To rectify this situation, the City of Daphne has requested that Baldwin County execute a deed transferring the right-of-way for Pollard Road from County Road 64 to Park Drive and for Park Drive from Pollard Road to US Highway 98.
