Recommendation

Approve the first amendment to the Development Agreement for Preliminary Engineering, Right-of-Way Acquisition, Utility, Construction, Project Management and Funding between Buc-ee’s Alabama, LLC, and the Baldwin County Commission.  This first amendment amends that certain Agreement entered into on December 5, 2017.

BACKGROUND INFORMATION

 

Previous Commission action/date:  December 5, 2017 - The Commission approved a Development Agreement between Baldwin County and Buc-ee’s Alabama, LLC, for preliminary engineering, right-of-way acquisition, utility, construction, project management and funding for a Buc-ee’s travel center in Baldwin County.

 

Background:  On December 5, 2017, the Commission executed a Development Agreement with Buc-ee’s Alabama, LLC, related to the construction of the new Buc-ee’s travel center at the Baldwin Beach Express (BBE) and I-10 interchange.  Among other provisions, the Agreement required the County to manage the construction of traffic signals at the intersection of BBE and CR 68 and at the west-bound I-10 ramps and the BBE.  The signal construction at each location was to be completed in accordance with a schedule that was attached to the agreement.

 

Due to unforeseen problems in the signal pole manufacturing industry, the signal pole procurement time has increased from 16 weeks to an anticipated 23 weeks.  The substantial time increase in procurement warrants an amendment to the Development Agreement.
