STAFF RECOMMENDATION
Recommendation
Approve the Reimbursable Utility Agreement between the Baldwin County Commission and Baldwin EMC for the relocation of utilities to complete the County Road 9 Bridge Replacement over Barner Branch. The total cost of this relocation is $5,674.98 with the Alabama Department of Transportation providing an 80% match at $4,539.98 and Baldwin County providing the remaining 20% at $1,135.00. (This agreement shall be effective upon full execution and will terminate upon completion of the project).

BACKGROUND INFORMATION
Previous Commission action/date:
May 16, 2017 - The Commission approved Resolution No. 2017-088 and an Agreement for Preliminary Engineering on a Federal Aid Project for the Alabama Department of Transportation Project - Bridge Replacement on County Road 9 over Barner Branch. Funding is subject to availability of Federal Aid Funds at the time of authorization. (Agreement shall be effective on the date of the approval of the Governor of Alabama and may be terminated by either party upon delivery of a thirty (30) day notice of termination.)
March 21, 2017 - The Commission approved 1) Resolution # 2017-074 and a Letter of Intent requesting to Utilize Federal Aid Funds relating to Project BCP 0204517 to replace Baldwin County Bridge No. 105 on County Road 9 over Barner Branch; and 2) the Chairman to execute all associated documents required to see this project to completion with the exception of the formal agreements between Baldwin County and The Alabama Department of Transportation.
