Baldwin County Sewer Service Utility Lease Request - Magnolia Landfill

STAFF RECOMMENDATION
Recommendation
Approve a License and Use Agreement between the Baldwin County Commission and the Baldwin County Sewer Service for a 40’x40’ utility agreement for the installation of a lift station on county owned property adjacent to Magnolia Landfill (northeast corner of PIN 213289) on County Road 28.
The term of this Agreement shall be for thirty (30) years from the date of last execution, with automatic renewal terms of ten (10) years each unless cancelled in writing by one or more parties no later than 180 days prior to the end of the term then in effect, unless terminated sooner in accordance with Paragraph 9 of the agreement.
BCSS shall make a payment to the County of $15,000.00 within two (2) days of the Effective Date and one and no/100 dollar ($1.00) payable every year thereafter on the 18th day of June during the term of this Agreement.

Background: Mr. Clarence Burk of Baldwin County Sewer Service contacted Mrs. Terri Graham, Development and Environmental Director, requesting a 40’x40’ License and Use Agreement with the Baldwin County Commission for the installation of a lift station, this request was discussed at the May 14, 2019 Baldwin County Commission Work Session.
