Recommendation

Authorize the County Commission Chairman to sign a letter to the Baldwin County Legislative Delegation requesting amendments to the Baldwin County Planning and Zoning Enabling Statues as they pertain to the Boards of Adjustment.End

 

BACKGROUND INFORMATION

 

Previous Commission action/date:  N/A

 

Background:  The Baldwin County Commission, as required by statute, currently has four (4) Boards of Adjustment which correspond to the four (4) Commission districts.  This includes seats for twenty-four (24) regular members and twenty-four (24) alternate members, with each alternate being appointed to a term which is concurrent with a specific regular member.  In recent years, it has become increasingly difficult to find qualified members who are willing to serve and attend scheduled meetings on a regular basis.  To address this situation, the Planning and Zoning staff has drafted proposed amendments to the statues which would reduce the number of Boards of Adjustment to two (2) and provide for flexibility in terms of the usage of alternates.  If approved, one board would have ten (10) members while the second board would have eight (8) members.  In addition, the number of alternates for each board would be no less than two (2) and no more than the same number of regular members.

 

A draft letter to the Legislative Delegation requesting the amendments is attached. Copies of the current statute and the proposed amendments are also attached for the convenience of the County Commissioners.
