Recommendation

Authorize staff to advertise for a public hearing to be held on August 6, 2019, for the Baldwin County Commission to consider amending the Baldwin County Subdivision Regulations.

BACKGROUND INFORMATION

 

Previous Commission action/date:  May 7, 2019

 

The Baldwin County Commission approved the following actions:

 

1) Move the Parks Department and the Baldwin Regional Area Transit System (BRATS) Department from the Highway Department to the Office of County Administrator; and

 

2) Update the Organizational Chart that will reflect the same; and

 

3) Move the function of the Subdivision Plan Review and supporting staff from the Highway Department to the Planning Department effective September 6, 2019. The relocation of the Subdivision Plan Review will not change the construction inspection process and is only intended to affect the planned review of subdivisions which are heard by the Baldwin County Planning Commission and administrative extraterritorial jurisdiction (ETJ) review prior to construction; and

 

4) Amend the Subdivision Regulations to reflect changes of the new review structure.

 

Background: 

 

The Baldwin County Commission has previously approved/adopted Subdivision Regulations for unincorporated Baldwin County as authorized by applicable general or local law. The Subdivision Regulations were last amended by the Baldwin County Commission at its May 15, 2018, Regular Meeting pursuant to the adoption of Resolution #2018-076.

 

The amendment procedure in Article 12.1 of the Subdivision Regulations states:

 

“For the purpose of providing for the public health, safety and general welfare, the County Commission may from time to time amend these regulations. Any proposed amendment of these Subdivision Regulations shall be subject to a public hearing. Notice of said public hearing published once a week for three consecutive weeks in a newspaper of general circulation in Baldwin County, with the first notice being published not less than a minimum of eighteen (18) days prior to the date of the public hearing. In addition, a notice shall be published at least five days prior to the date of the public hearing in the regular section of the newspaper which shall be in the form of at least one quarter page advertisement. The notice shall state that an ordinance or regulation, or amendment hereto, will be considered by the Baldwin County Commission pursuant to this article and that a copy of the proposed ordinance or regulation, or amendment hereto, is available for public inspection at the nearest county courthouse or the nearest county courthouse satellite office which locations shall be clearly published in the notice. The notice required to be published by this article shall also state the time and place and location where all persons may be heard in opposition to or in favor of the ordinance or regulation or amendment hereto. A copy of the proposed amendments shall be made available to any interest person before said public hearing. A copy of the amendment shall be certified by the County Commission to the Probate Judge of Baldwin County.
