STAFF RECOMMENDATION

Recommendation

Approve the Memorandum of Understanding between Mobile Infirmary Association, Inc. d/b/a Mobile Infirmary Medical Center and Baldwin County Commission for the 340B Drug Pricing Program.

 

The Memorandum of Understanding (MOU) will be effective August 20, 2019, and shall continue until terminated by either party upon not less than sixty (60) days prior written notice to the other.

BACKGROUND INFORMATION

 

Previous Commission action/date:  N/A

 

Background:  On August 5, 2019, Commission staff received correspondence from Mobile Infirmary Association, Inc., d/b/a Mobile Infirmary Medical Center requesting the Baldwin County Commission to approve a Memorandum of Understanding for the federally created drug discount program referred to as the 340B Program, which provides care to low-income individuals who do not qualify for Medicaid or Medicare. 

 

In order for the hospital to be eligible to participate in the 340B Program, federal law requires that a private non-profit hospital have a contract with state or local government.  The MOU should satisfy the requirement created by the 340B statute and memorialize the Hospital’s ongoing commitment to care for indigent patients in Baldwin County.
