Recommendation
Take the following actions:
1) Rescind the action taken by the Baldwin County Commission, during its regularly scheduled meeting on July 16, 2019, more specifically, Agenda Item BM6, which approved as follows:
“AUTHORIZE THE CHAIRMAN TO EXECUTE AN AGREEMENT BETWEEN H. O. WEAVER AND SONS, INC. AND BALDWIN COUNTY FOR THE FOLLOWING:
1) USE OF OLD MOBILE ROAD AS A “LOCAL TRAFFIC ONLY” DETOUR DURING THE INSTALLATION OF A NEW DRAINAGE PIPE UNDER US HIGHWAY 31; AND
2) THE RESURFACING OF OLD MOBILE ROAD UPON COMPLETION OF THE PROJECT.”
2) Authorize the Chairman to execute the revised agreement between H.O. Weaver and Sons, Inc. and Baldwin County for the following:
a) Use of Old Mobile Road as a “Local Traffic Only” detour during the installation of a new drainage pipe under US Highway 31; and
b) The resurfacing of Old Mobile Road upon completion of the project.

BACKGROUND INFORMATION
Previous Commission action/date: N/A
Background: H.O. Weaver and Sons, Inc. is requesting to use Old Mobile Road as a “Local Traffic Only” detour while they are installing a new drainage pipe under US Highway 31. The detour will be needed for up to 12 days. For use of the road, H.O. Weaver and Sons, Inc. will resurface the unimproved section of Old Mobile Road (approximately 1,300 feet) upon completion of the project.
H.O. Weaver and Sons, Inc. requested changes to the agreement. Changes were made to the following:
Item 1C. The Contractor will follow the County’s resurfacing Guidelines for Operations to resurface Old Mobile Road. The Contractor will resurface Old Mobile Road using asphalt mix BC723 at a rate of 165# 110# per sq. yd. or other mix and rate approved by Baldwin County. The County will perform all striping and markings at no cost to the Contractor.
Item 2. Approval by County of Maintenance and Resurfacing: During the period of use as a detour road, any maintenance required resulting from its use as a detour road must be approved by the County before the maintenance is performed. Resurfacing will take place once the new configuration of Old Mobile Road is completed as part of the Alabama Department of Transportation U.S. Highway 31 project. Upon the completion of resurfacing of Old Mobile Road, the County will inspect the resurfacing performed and shall notify Contractor of accepted as complete.
