Baldwin Regional Area Transit System (BRATS) - Zero Tolerance Substance Abuse Policy

STAFF RECOMMENDATION

Recommendation

Adopt Baldwin Regional Area Transit System’s amended Substance Abuse Policy which is in accordance with the 5311 and 5307 grant requirements of the Federal Transit Administration and Alabama Department of Transportation for the transit industry.  This amended policy will supersede any previously adopted Substance Abuse Policy for Baldwin Regional Area Transit System (BRATS).

BACKGROUND INFORMATION

 

Previous Commission action/date: 

08/15/2000 - The Baldwin County Commission approved and adopted the BRATS Substance Abuse Policy.

08/19/2003 - The Baldwin County Commission accepted and approved the amended the BRATS Substance Abuse Policy.

06/15/2010 - The Baldwin County Commission adopted the amended BRATS Substance Abuse Policy.

11/02/2010 - The Baldwin County Commission adopted the amended BRATS Substance Abuse Policy.

02/06/2018 - The Baldwin County Commission adopted the amended BRATS Substance Abuse Policy.

 

Background:  The Alabama Department of Transportation has requested revisions to the previous version of the BRATS Zero Tolerance Substance Abuse Policy in order to meet the Federal Transit Administration requirements of listing the minimum thresholds as established in 48 CFR Part 40 for screening cut off and confirmation cut off levels per drug name.

The purpose of the BRATS Zero Tolerance Substance Abuse Policy is to assure worker’s fitness for duty and to protect employees, passengers, and the public from the risks posed by the misuse of alcohol and the use of prohibited drugs.  This policy is intended to comply with all applicable Federal Regulations and the Federal Transit Administration (FTA) of the U.S. Department of Transportation (DOT) which governs anti-drug programs in the transit industry.  This policy will not replace the Baldwin County Commission’s Drug-Free Workplace policy.  This policy will coincide with the current Personnel Drug-Free Workplace policy using whichever policy is more stringent as indicated within the policy of the BRATS Department.  This policy will be housed in the Baldwin Regional Area Transit System’s Standard Operating Procedure Guidelines.
