Medicaid for County Inmates Pilot Program - Memorandum of Understanding between the Baldwin County Commission and the Alabama Medicaid Agency

Recommendation

FOR DISCUSSION:

 

Approve a Memorandum of Understanding (MOU) between the Baldwin County Commission and the Alabama Medicaid Agency for the exchange of necessary data to coordinate reinstatement for certain services provided to Medicaid recipients who are inmates of a public institution under the administrative control or responsibility of the County Sheriff and for whom the County is responsible for the provision of medical care. 

 

This Agreement shall be effective during a pilot period of ____TBD___, 2020 through ____TBD____, 2023, and except as otherwise provided, shall remain in effect for such term until terminated by agreement of both Medicaid and Baldwin County or upon thirty (30) days written notice to the other party.  This Agreement may be amended as required, provided that such is in writing and signed by both Medicaid and Baldwin County.

BACKGROUND INFORMATION

 

Previous Commission action/date:  See below.

 

Background:  In 2017, the Association of County Commissions of Alabama (ACCA) began working with the Alabama Medicaid Agency to implement a new Medicaid for County Inmates Program.  After all details were finalized, a Pilot Program was started in 2018. 

 

The inmate data report that many counties already submit to the Social Security

Administration contains all of the necessary information required under the 2017 law which provides that Medicaid benefits should be suspended, but not terminated, for certain county jail inmates under certain circumstances.  Baldwin County was one of the Alabama counties participating in the pilot program, but the technical aspects of implementing the program proved to be too many to resolve during the limited duration of the Memorandum of Understanding that was in place at that time.

 

At this time, ACCA is requesting that Baldwin County recommit to the pilot program and participate in the efforts to get the program operational.  Baldwin County would be the only county to participate in the pilot program and the goal is for the flow of data between Baldwin County and the Medicaid Agency would allow ACCA to resolve the remaining technical issues in the program, so it could become a valuable resource for Alabama counties. 

 

PAST ACTION TAKEN BY THE COMMISSION:

 

10/03/2017 - Authorize the Baldwin County Sheriff's Office to submit a Non-binding Notice of Intent to the Association of County Commissions of Alabama (ACCA) to Participate in the Medicaid for County Inmates Program as authorized by Act 2017-298.

 

10/17/2017 - Take the following actions:  1) Adopt Resolution #2018-017, Joint Resolution to Participate in the Medicaid for County Inmates Program; and

2) Authorize the Chairman to execute the Medicaid for County Inmates Program Participation Agreement between the Baldwin County Commission, the Baldwin County Sheriff's Office and the Association of County Commissions of Alabama (ACCA); and

3) Authorize the Chairman to execute the HIPAA Business Associate Agreement between the Baldwin County Commission, the Baldwin County Sheriff's Office and the ACCA.

 

03/06/2018 - Take the following actions:  1) Approve the Memorandum of Understanding between the Baldwin County Commission and the Alabama Medicaid Agency regarding the exchange of necessary data to coordinate reinstatement for certain services provided to Medicaid recipients who are inmates of a public institution under the administrative control or responsibility of the Baldwin County Sheriff and for whom the County is responsible for the provision of medical care.  This Agreement shall be effective during a pilot period of January 1, 2018, through December 31, 2018, and except as otherwise provided, shall remain in effect for such term until terminated by agreement of both Medicaid and Contractor or upon thirty (30) days written notice to the other party.  This agreement may be amended as required, provided that such is in writing and signed by both Medicaid and Contractor.  2) Authorize the Chairman to execute any related documents.
