STAFF RECOMMENDATION

Recommendation

Take the following actions amending the request for an Attorney General’s Opinion regarding the responsibility of Bluewater Drive and Pine Drive in the Town of Elberta:

 

1) Adopt and authorize the execution of Resolution #2020-058; and

 

2) Authorize the Chairman to execute correspondence to Steve Marshall, Alabama Attorney General; and

 

3) Approve and authorize the execution of any and all such other related documents by the Chairman necessary to authorize and affect the request of the above Attorney General’s Opinion.

BACKGROUND INFORMATION

 

Previous Commission action/date:  June 4, 2019, BCC Regular Meeting - The Commission approved the following action related to a request for an Attorney General’s Opinion regarding the responsibility of Bluewater Drive and Pine Drive in the Town of Elberta:

 

1) Adopted and authorized the execution of Resolution #2019-098; and

 

2) Authorized the Chairman to execute correspondence to Steve Marshall, Alabama Attorney General; and

 

3) Approved and authorized the execution of any and all such other related documents by the Chairman necessary to authorize and effect the request of the above Attorney General’s Opinion.

 

Background:  On June 4, 2019, an Attorney General’s Opinion was requested to determine the responsibility of Bluewater Drive and Pine Drive in the Town of Elberta.

 

As of this date, the Attorney General has not issued an opinion.  The County Attorney would like to amend the initial request and submit two additional issues for an Attorney General’s opinion.  A resolution is needed to add the additional issues.
