STAFF RECOMMENDATION
Recommendation
To accomplish the provisions set forth in the adopted 2018 International Building Codes, Administration, Section 113, Board of Appeals and the Baldwin County Commission Resolution #2019-075 and #2020-119, take the following actions:
1) Re-appoint Mr. Cliff Pitman as a regular member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023; and
2) Re-appoint Mr. Mark Acreman as a regular member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023; and
3) Re-appoint Mr. Malcom “Mack” Byrd as a regular member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023; and
4) Re-appoint Mr. Richard Peterson, P.E. as a regular member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023; and
5) Re-appoint Mr. Timothy Barnhill as a regular member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023; and
6) Re-appoint Mr. Martin Pitts as an alternate member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023; and
7) Re-appoint Mr. Clayton Salter as an alternate member of the Baldwin County Building Code Board of Appeals for a three (3) year term, such term continuing from October 21, 2020 and expiring on October 21, 2023.

BACKGROUND INFORMATION
Previous Commission action/date: Baldwin County Commission approved previous Board Members 02/20/2018; adopted new building codes 05/19/2019; amended new building codes 10/06/2020.
Background:
The Baldwin County Commission adopted new building codes for Baldwin County pursuant to Resolution #2019-075 of the Baldwin County Commission during the May 21, 2019 regular meeting and amended the building codes pursuant to Resolution # 2020-119 of the Baldwin County Commission during the October 6. 2020 regular meeting. See attached Resolution #2019-075 and Resolution #2020-119.
The new building code provide at Section 113, entitled “Board of Appeals” that there be a board of appeals to hear and decide appeals of orders, decisions or determinations made by the Baldwin County Building Official relative to the application and interpretation of said building code (which include all codes authorized by Resolution #2019-075 and #2020-119).
Section 113, as aforementioned described, provides no required composition for said board, only that the shall be appointed by the governing body (i.e., Baldwin County Commission) and shall hold office at its pleasure; furthermore, that the board shall consist of members who are qualified by experience and training to pass on matters pertaining to building construction and who are not employees of the jurisdiction (i.e., Baldwin County Commission).
The Baldwin County Building Official nominates the persons identified in the above Staff Recommendation to sit on the Baldwin County Code Board of Appeals and for a three (3) year term each; further, there would be two (2) alternate members in the case that a regular member was unable to make a meeting or to establish a quorum, if necessary. The aforementioned is acceptable if approved by the Baldwin County Commission.
The Baldwin County Building Official’s office has confirmed to staff that the persons referenced in the Staff Recommendation are residents of Baldwin County and, furthermore, are persons qualified by experience and training to pass on matters pertaining to building construction and who are not employees of the jurisdiction; therefore, staff confirms the foregoing persons are qualified to be appointed.
