Recommendation
With regard to the Baldwin County Boards of Adjustment, take the following actions:
1) Approve the consolidation of the Boards of Adjustment for County Commission District #1, County Commission District #2, and County Commission District #3, into one board of Adjustment to be known as Board of Adjustment #1; and
2) Approve the renaming of the Board of Adjustment for County Commission District #4 to Board of Adjustment #2.

BACKGROUND INFORMATION
Previous Commission action/date: July 2, 2019
Background: On May 8, 2020, an amendment (Act #2020-177) to the Baldwin County Planning and Zoning statutes was adopted pertaining to the Boards of Adjustment. The Code Section in question is Alabama Code Title 45, Local Laws Section 45-2-261.10. As approved, the amendment reduces the number of Boards of Adjustment from four (4) to two (2), provides for the organization of the Boards, provides for the appointment of regular and alternate members, and provides flexibility in terms of the usage of alternate members. Board of Adjustment Number One shall serve western, central, and northern Baldwin County and shall include Planning (Zoning) Districts 4, 10, 12, 15, 16, 28, and 31. Board of Adjustment Number 2 shall serve southern Baldwin County and shall include Planning (Zoning) Districts 20, 21, 22, 23, 24, 25, 29, 30, 32, and 33. In the event a new Planning (Zoning) district should vote in favor of coming under the Planning and Zoning authority of the Baldwin County Commission, said Planning (Zoning) District shall be included with the Board of Adjustment having the closest geographic relationship. A copy of the amended legislation is attached.
Staff now respectfully requests the following actions:
1) Approve the consolidation of the Boards of Adjustment for County Commission District #1, County Commission District #2, and County Commission District #3, into one board of Adjustment to be known as Board of Adjustment #1.
2) Approve the renaming of the Board of Adjustment for County Commission District #4 to Board of Adjustment #2.
It should be noted the existing Board of Adjustment for County Commission District #4 includes Planning (Zoning) districts 20, 21, 22, 23, 24, 25, 29, 30, 32, and 33. As a result, a consolidation is not needed for this Board.
Upon approval of this agenda item, staff will schedule an organizational meeting to determine meeting dates and times. Staff will then return to the County Commission with recommendations for membership appointments.
